He testified that his term ination was racially motivated and in retaliation for his participation in voicing com plaints o f other minorities. Judge Bums found that Emanuel had a pattern o f discrimination in 1977. That year 45 Blacks and 53 others were term inated, w ith 173 Blacks and 1,504 others voluntarily term inated or not term inated. Blacks comprised 131 per cent o f the hospital staff but made up 47.8 per cent o f the firings. In the house keeping department 37 per cent were Black and 47.8 per cent o f those fired were Black. Judge Burns concluded that this statistical evidence demonstrated a disparate effect o f Emanuel’s ter mination practices on Blacks. Therefore, unless Emanuel could articulate a legitimate work-related reason fo r actions taken against Blocker, he would presume the ac- tions were racially motivated. However, he found that ‘ Block er’ s employment record, his own adm ission that the reprim ands were based on incidents which in fact occurred, lead to the inevitable con clusion that Blocker’ s work perfor- mance was not adequate.” Attorneys for Emanuel and Red Top Service are Robert E. The students were participating in an orientation session to learn about career opportuni ties w ith the corps and other federal agencies. M any high school students are employed in the sum m er aide program, mostly in clerical positions. It is intended to supply fill-in help in offices short-handed because of vacationing staff and is aimed at helping economically underprivileged students. Some of these students continue their employment with the corps under the stay-in-school pro gram which provides opportunities for those who need to work to con tinue their educations.
