The answer was no, because un t il that time there had been no law on the subject. And new laws cannot be applied to actions that have occurred in the past. This rule against “ ex post facto” laws is laid down in Article I o f the Constitution. Based on ele mentary fairness, it applies not only to the creation o f new crimes but also to the increasing o f punishment fo r an existing crime. Thus: H arris pulled off a fraudulent land deal. A t the time, the pre scribed punishment fo r his o f fense was two years in prison. But by the time he was caught and brought to trial, the legislature had upped the penalty to fo u r years. The judge tried to impose a four-year sentence, but a higher court ruled that he could not law fu lly do so. The court felt Harris was entitled to know, at the time he committed the fraud, how seri ously it was looked upon by so ciety. However, the rule applies only in the field o f crim inal law. C ivil disabilities may indeed work re troactively. F or example; A new law declared that no one who had ever been convicted o f a felony could get a license to prac tice medicine.
