Portland's railroad terminal situa tion is now up to the interstate commerce commission, the public service commission -of Oregon and the city having- wired- a brief out line of the case, and full details axo on the way by mail. The vital feature now is to obtain a stay of execution of the ouster order, served on the Great Northern and the Spokane, Portland & Seattle lines by the Isorthern Pacific Ter ir.inal company, 60 per cent of the stock of which Is controlled by the Southern Pacific and Union Pacific ffyrstems. On behalf of the state commission Fred U. Buchtpl, chairman, last night wired to Clyde B. Aitchison of Ore- son, a member of the Interstate com incrce commission, and to John L. Benson, general solicitor at Washing ton, D. G urging the necessity and treat importance of an emergency re straining order. Mr. Bucbtel wired Mr. Aitchison personally, not only bo ra aye he is in intimate touch with the situation here, but hscause be eared some r.f the other members rt'ight be away from the capital on vacation, and he is of the opinion that - Mr. Aitchison will make a special ef fort to get the facts before the mem bers at the earl.est possible time. Injunction Is Sought. It Is to obtain such an injunction to prevent the execution of the ous ter notice, effective December 31, that the members of the Btate com mission and the city council, also Mayor Baker's special civlo clubs committee, are now directing their fforta. The time is so short that they are urging their case before the interstate commission by telegram. A reply is expected at any time, and It is bolieved that the restraining order will be granted, but that a hearing with relation to it will be held, either here or in Washington, D. C, and that it may be necessary to send personal representatives to go into full details. As previously published, Fred G. Buchtcl, chairman of te state public service commission, personally took up the city's terminal cas when it was first submitted to the comrais eion last week, leaving State Com missioners Corey and Williams in charge of the gas hearing, which is in progress, in order to give the ter minal subject full attention. Data were compiled by the commission's staff and the full brief dispatched to Washington by registered letter yes terday. In addition telegram carried a brief outline and stressed the urgency of a restraining order to eave the public great confusion ann inconvenience should the terminal tenant roads be permitted to oust the non-tenant lines December 31. Special Committee Meets. Mavor Baker's special committee, f which H. B. Van Duzer, president of the Chamber of Commerce, is chairman, met at noon yesterday, heard a statement from City Attor ney La Roc he, committee secretary; on the recent developments in the case, and voted to send, if necessary, one of its own members to Washing ton, D C, to supplement any others the city or state might send and to show the interest of the city's civlo organizations in the case. The clubs represented on the com mittee by their presidents also will back up the officials in the case in creating sentiment, it "was voted. Ttlrgnms are Sent. Telegrams were sent to the inter Ftate commission yesterday by Mr. Van Duzer, chairman of the mayor's committee, and by Mr. LaRoche as citv attorney. Mr. Van Duzer wired: "This committee, representing all of the civic organizations of the city of Portland, urges you to grant the petition for a preliminary order pre serving the present status1 in the matter of public service commission against Northern Pacific Terminal company, filed with you, so that the matter may be fully investigated on ts merits." Mr. LaRoche's telegram was as follows: "City of Portland desires to inter vene in public service commission of Oregon against Northern Pacific Ter minal company and others and re quests present situation be preserved until you can pass on merits oi peti tion. Therefore urges favorable ac tion on application for preliminary order as this action is vital to inter ests of Portland." CALIFORNIA ASKS FOR DATA Information as to Portland Ter minal to Be Used In Oakland. SALEM, Or., Dec. 20. (Special.) The California public service commis sion has written to the Oregon pub lic service commission asking for information with regard to the stat us of th&Portland terminal, joint use of which is in controversy at the present time. Information to be fur nished by the Oregon commission will be used, according to the letter from the California officials, in set tling a dispute involving the Oakland Pier terminal, which is being used jointly by the Santa Fe and South ern Pacific railroads. Fred G. Butchel, chairman of the Oregon public service commission, said today that It was his under standing that the controversy at Oak land was somewhat similar to that involving the Portland terminal. Sing settled his debt yesterday and announced in federal court his permanent retirement from the soft drink business In Portland and adher ence to his regular cannery line in the future. , Sing got into the retail business here last June, and soon afterward federal investigators noticed a num ber of patrons with uncertain footing emerging from his place in the north end. They entered and found about 100 gallons of extremely hard cider. It was. Sing's practice to pour his new stock into an old keg with plenty of dregs in the bottom. This speedily generated alcohol, and his place proved popular until closed. Judge Wolverton levied the fine.
