Dr. Marie Equl will take th witness stand today in the Federal Court, where aha Is on trial chaired with violation of the espionage act. by referring in disparaging' re marks to the flag and the soldiers. ' Fourteen witnesses for the defense were called yesterday. These were edther character witnesses, who never heard Dr. Equi's loyalty discussed and considered her reputation for loyalty rood, or else they wera members of the I. W. W.. with soma exceptions, who beard her talks and testified that they did not hear her speak disrespect folly of the flag. Army or Navy. Former Governor Oswald West was recalled to the stand yesterday morning and said that ho had never heard her loyalty discussed. Others who testi fied in a similar strain wera Dr. Kath arine C Manion, a college-mate of the defendant; Dr. Viola May Coe. Frank Council; E. J. Stack, secretary of the State Federation of Labor; and Cir cuit Judge W. N. Catena. John Hays, a attockman of Central Oregon, said he had never heard the woman's loyalty Questioned except once, up in the bunch irrass country, where someone did not think aha waa loyal, because of stories in the newspapers. Dr. Equl recently attended the stepdaughter of Mr. Hays, the young woman dying of Influenza si few days ago. Caok Volaateer Witness. Several witnesses were present St the T. W. W. hall, where Dr. Equi Is said. to hava made the disrespectful re marks. One of these was Edwin Mel 11ns, who has been cooking for the sol diers in the spruca division at Miami, in Tillamook County. Mellins, who is a veteran of the Boer War, said ha bad dropped Into the I. W. W. hall on the night in question to rest and read. He ; considered all of Dr. Equis remarks uninteresting until she referred to the frustrated rebellion in Ireland. This was the only point in her talk which attracted his attention, he eaid, but he rave her half an ear while he was reading. He heard no reference to the flag or the Army and came as a volun teer witness when he read In the press that the doctor was on trial. He said a spirit of Justice prompted him to volunteer his testimony, for had he heard her or anyone else speak disre spectfully of the flag or the Army he would have fought her on the spot.' The most remarkable thing about Mellins' testimony was his ability to recall what ha was' doing at any hour on any date mentioned by United States Attorney Haney. Deputy United States Marshal Frank Berry was called by th defense. Berry said he was at a meet ing where Dr. Equl spoke, but heard nothing out of the way. Mr. Curtis had heard nothing unpatriotic in a plaza talk of the doctor. ' Blanket Day Retailed. A typical soapbox L W. W. speech was delivered from the stand by Dave Morris, an I. W. W. and former organ iser. He made a talk about "Blanket Day," when, on May 1 last, all lumber jacks were urged to burn their blan kets but there wasn't much of a burn in. Morris testified that he never saw an American flag in an I. W. W. hall, as "they don't use It there." H ssserted that no references were made to the flag or Army by Dr. Equl on the night she is supposed to have made the utterances. Frank H. Nash., born In Hartford, Conn.. 8 years ago, and an L W. Wood, testified that he witnessed part of the rumnus in the Preparedness-day pa. rade. when Dr. Equl Is said to have flunar an American flair to tne street. Wood did not see that part of the af fair. The report Is in 13 volumes, but Vandeveer quoted from a booklet hitting the high spota The argument of the defense will ba that it was from this booklet tnat Dr. t-qui spoke in the L W. W. hall, and that when a person reads from official Gov ernment documents the reading cannot be considered disloyal. The evidence of the Government against Dr. Equi depends principally on the reports of operatives of the mili tary Intelligence department who at tended the meeting, and the testimony of two men who claim that she made slurring remarks when a military fun eral passed the Plaza where she waa speaking. ESCAPED CAPTAIN RETURNS Herbert Magmissen, of Raymond, Home From Petrograd. RAYMOND, Wash., Nov. 15. Spe clal.) Herbert A. Magnussen, a former resident of Raymond, arrived In this city today from New York, where he landed a-little over a week ago on bis return from Petrograd. Ha was a Captain of the Red Cross and was one of tha number that escaped from Petrograd after Lenins was shot. Frank Ruege, of Chehalls. was Instantly killed at Wlnlock last even ing while demonstrating a tractor. Ruege had just completed his demon stration work and while taking the ma chine from the field hit some soft ground. Lifting the plows, he applied a chain in some manner so that when the power was connected the tractor turned over on him. The deceased was 28 years old and had for two or three years been em ployed by the Twin City Automobile Company, of this city. He was mar. ried, his wife being in Olympia when the accident occurred.
