Brandt, of Pleas ant Valley. In a suit filed in the Cir cuit Court here today. Brandt wants :5 for the crop. The alleged harvesting Is also the csuse or a rase in tha Haines Justice Court. (Spe cial.) While obeying the advice of the State Tax Commission, tha Board of Equalisation of Clarke County, sitting at Vancouver, Wash., may find Itself in contempt of court. VANCOUVER, Wash., Aug. 20 (Epe- claL) The warm, weather during the past few days, apparently haa reduced the number of visitors to Vancouver to be married, but three couples today braved the upper 90 s and obtained the coveted papers. Many Inquiries have been made as to the nature of the oath of the witness when tha license is issued. The oath follows: "L (name ot witness), being duly sworn, state that I am personally ao quainted ' with (name ot bridegroom elect), of (city), and know him to be over the age of 21 years, also, that I am personally acquainted with (bride- elect), of (city), ana know her to se over the age of IS years. Hedges, acting District Attorney, today when he read an interview referring to the jurisdiction of Multnomah County in the Hill case. Ex-District Attorney Collier, of Multnomah County, had said that "the law provides tnat wnen a crime Is committed within a mile of the county line, either county may take action" and then added that "thij pro- viaion of the statute is piain. Mr. Hedges looked into (he state law still further today and was more strongly convinced that Multnomah County cannot Investigate the Hill mur der. He found a decision of the Su preme Court in re Kelly In which it was held that preliminary examination is a part of the criminal procedure and must be made in the county In which the crime was committed. Mr. Hedges explains the Roberts case, mentioned by Mr. Collier, in which Jack Roberts was tried in Portland for murder in this county by mentioning tha fact Roberts was arrested ty kod- ert Stevens, then Sheriff of Multnomah County, and his victim died in a Port land hospital. i 'I am willing to staKe my reputation aa-alnsl that of Mr. Collier that the Sunreme Court would hold that the lo cation of the scene of the crime must ba in doubt, or the location of the county boundaries must be questioned, before the case comes within the juris diction of either one of two counties," declared Mr. Hedges. Ross, noted for her connection with the North P.lver night riding cases, left here Thursday for San "Francisco, whence she will go to Iowa as a witness In the 1100,000 and $50,000 libel suits be ing brought by George Egan against the Sioux City Tribune and Sioux Falls Press. Mrs. Roes stumped the- state in 1910 against Egan. She will appear as a witness for the defendants. Before leaving she said she had assurance that the night riding cases would be continued In the attempt to secure a prosecution of some of the alleged night riders. BITULITHIC IS WINNER Upper Washington-Street Contract Awarded on $10,633 Bid. Being convinced that the majority of property owners on Upper Washington street want bitulithio pavement for the resurfacing of their street, the Council yesterday awarded the contract for the paving to Oskar Huber, who tendered the lowest bid for that type of hard surface. The bid of Mr. Huber was J1.10 a square yard, or a total of $10,635.85 for the entire Job from Twentieth street to Washington Park. The bitulithlc bid was about $2000 higher than the low est bid for asphalt pavement. Commis sioner Biffelow voted against the award for bitulithlc. TRAIN KILLS WORKMAN M. F. Jones, Employed by Twohy Bros, on New Terminal, Is Hit. PENDLETON. Or., Aug. 20. (Spe cial.) M. F. Jones, 55 years old, a labor employed by Twohy Bros., was Instantly killed at noon today when he was run down by a work train at Pilot Rock Junction, where Twohy Bros, are excavating for the new O.-W.
