On the Cowlltx River less water will prove beneficial now In connection with the work of raising the Government dredge Cowlltx. which sank a week ago. but may Interfere wtth the operation of the steamer Chester, which resumed service last week after a long period of idleness. A, experts that re ports from th Columbia River Jetty for November will show that between 75.0OO and SO.00O tons of rock were dumped from th trestle. Th east wind prevailing makes work much easier for the train crews and dispels th fog. As soon as th Port of Portland can return th steamer Ocklahama to As toria, after towing the Conway Castl here, the waterlogged schooner William Nottingham will be brought to Port land and lifted on th public drydock for examination. It Is expected that she will leave up tomorrow. Th schooner was picked up at sea by th tug Oneonta after being abandoned by her crew, who wer taken off by th British schooner David Evans. Member of th crew of the steamer Westerner, which was sunk November 11 by the steamer Porter, have been paid off and most of them will return to San Francisco today on th steamer Bear. The crew of the disabled steamer Washington Is standing by during her repairs. The Washington was released by United States Marshal Scott yester day, after a bond in the sum of $10, 000 was filed as was demanded In con nection with the libel for salvage Insti tuted by the Puget Sound Tugboat Company. Draktor, who declares the vendor threatened to kill him Some weeks ago Jacoba spent four days In Jail after Draktor had preferred a coarse of larceny against him, but the case was dismissed. Then Jacobs brought suit for 1:200 for falsa arrest. The case was referred to arbi trators, who awarded Jacoba $S0. In which nearly all tha rail roads operating through this part of th country hav exhibits. Th Ureat Northern has a space 110 feet long by II feet wide on th right of th main entrance. A large electric chaser and artistic arrangement of plate displays of choice ailos are among the principal features. In addi tion there ar 180 display boxes of apples of all principal varieties, with grains and grasses on th back wall, processed fruits, and a display of pic tures of Glacier National Park, all ar ranged attractively. Western Industrial and Immigration agent of the Great North- J ern. who la attending th ChlcaRo show. writes that visitors hav voted th Great Northern exhibit the finest In th Coliseum. The Northern Pacific, which had on of the best exhibits at the New Tork Land Show, has moved Its entire dis play to Chicago, and Is creating much Interest In th Northwest thereby. In addition, a special car will leave Spo kane today with products of Oregon, Washington and Idaho for a supple mental exhibit at Chicago. E, M. Elliott, of th famous Wenat chee Valley, has a seml-prlvate exhibit of apples and other products of that district. Th Spokane Valley Is well repre sented by a great variety of products from that fertile area. On of th most attractive features of tha -show Is that of th Montana Orchard Horn Company, of Kallspell, Mont. It consists of a display of 2000 boxes of apples with a clever mirror effect and the American flag worked attractively In the center of th ex hibit with different colored apples. These are listed and will be given attention by th commercial bodies of tha locali ties concerned. Attendance la Great, Attendance at th Land Show this year Is greatly In excess of any former year, according to telegrams received yesterday by William McMurray, gen eral paaaenger agent of the O.-W. R. & N. Company, and John M. Scott, gen eral passenger agent of tha Southern Pacific Railway. During the show In 1.10 on hall was found sufficient to accommodate visitors. This year It was found necessary to engage an addi tional halL Th Land Show In 1910 lasted two weeks, and during that Urn 77.000 persons attended the lecture in one halL For the first 10 days this year 76.000 hav availed themselves of th orivlleg of listening to tha speak ers In th two lectur rooms. It now looks as though th attendance this year will exceed 160,000. Saturday's attendance was 10,327. and Sunday's audiences consisted of S8S0 persons. Th County Court yesterday re ceived from Carey & Kerr, attorneys for the paclflo Telephone & Telegraph Company, a letter In answer to that from the Commissioners demanding to know by what right th company oc cupies th county roads with Its poles and wires. The reply, which was written by Harrison Allen, sets forth that Lord's Oregon Laws glv com panies such right, subject to the con trol of County Courts, and that an act of Congress of July J4, 1866. per mits telegraph companies to utilise all military highways or post roads then In existence or afterward to b created by law. Continuing. Mr. Allen declares that another act of Congress, of March 1. 1884. designated all roads and highways as post roads. The Investigation was undertaken by the County Court with a view to force the company to glv the county free telephone service In return for th us of th county roads. Just as th city Is allowed th greater number of Its telephones freo In exchange for fran chise privileges. Th Commissioners at one replied to the letter of th company's attorneys, calling attention to th fact that the state law referred to excepts streets, highways and roads within the Incorporated limits. "The county has a number of roads within the corporate limits of Port land. Oresham. Llnnton and other mu nicipalities within th county," said County Judg Cleeton. "These roads have never been taken over by the va rious municipalities as streets, yet the telephone company has poles and wires along them without having received franchises from the county. The Fed eral statutes which Mr. Allen refers to are not. In my opinion, applicable to this aituatlon, as the courts do not, I believe, hold that a telephone line Is a telegraph line." Judge Cleeton admitted that It Is possible that the County Court may now. by reason of laps of time and for other reasons, be estopped from or, dering th removal of many. If not all. of the lines which the company lias along county roads, but points out that the county can order changes In the position of tha poles and exercise other control which might prove annoying to the company. "When new lines come up for con sideration we will, of oourse, have a better chance to press our demands for free telephones," said the Judge. 26 NOT VACCINATED ILL Kpldemlc at Toledo Puts Town In Hard Straits for Time. Conditions there should forever silence the critics, who have been railing a train st vaccination." said Dr. Calvin S. White, secretary of tha Stats Board of Health. In referring to the situation at th Lincoln County seat yesterday. There ar now 26 cases of smallpox In that town, four new case-s having been reported yes terday, and of these not a single per son has ever been vaccinated' One tf the cases reported yesterday was that of Mrs. B. Arjcn. 83 years old, who refused to submit to vaccin ation, although seven In her family I have been vaccinated and are not af fected. She is the mother of Frank Carson, the village blacksmith, who was attacked with smallpox several years ago. Of th cases now at To ledo but three are of the severe type. The grlmness of the epidemic Is broken by touches of humor. When th epidemic broke out all sought se clusion, and It was difficult to find persons to perform the necessary pub lie duties, among them that of polic ing th town. Finally on of the patients approached a convalescent stage, and he was promptly designated Town Marshal, on the theory -that he could no longer suffer harm. One of the cases reported yesterday was that of the Town Marshal's wife. No cases of smallpox have thus far been reported at Newport, 14 miles away. The town Is still quarantined against Toledo. Dr. Calvin S. White left yesterday to Investigate condi tions there. RAIL LINE MAY LOAD TRAMP Flour and Wheat Held in Interior for Japan Ports. In exporting circles yesterday was discussed tha probability of the O.-W. R. & N. system being Interested In th charter of a steamer to carry flour and wheat to Japan, as It has consid erable freight along the. Una ready for Oriental shipment. Space Is not avail able on the Bank Line steamers and rates that will apply after January 1 ar regarded as too high. If a Portland firm will engage a carrier th rail road interests would supply most of her cargo.4 Waterhouse & Company were re ported to hav taken the British steam er Dunbar, which arrived November 13 at Bremerton from Baltimore, but she will probably be loaded in the North for the Far East. The steamer Kumerlc, which Is to sail tonight or tomorrow, was cleared yesterday with 4(7.000 feet of lumber worth $4970, SS.633 barrels of flour valued at $263, 632. and a small consignment of Ore gon apples, and miscellaneous cargo. She Is loading at the Alblna dock. The Lucerlc Is due In the harbor this week from th Orient, via Puget Sound, and will get away early In December. 74 ARE FOR ANNEXATION Lnta' Straw Vote) Shows 97 Fa-ror Incorporation or Old Rnle. Annexation Is leading by a plurality of 21 .votes In the straw ballot of the Mount Scott district being taken In Lents, to determine whether the resi dents favor annexation or desire sepa rate Incorporation. At the close of last week th vot stood: For annexation to Portland. 74 votes: for forming separate Incorpora tion, 63 votes; for remaining as at pres ent. 44 votes. The vot apparently shows a majority against annexation, as there were 87 votes for separate In corporation and to remain without either annexation or Incorporation. The straw vot will be continued this week. Taxation, fire protection, water rates, police and other subjects also ar dis cussed.
