Ed Johnson, ex-proprietor of the l"el lucnlco restaurant, at 149 Seventh street, is on trial before a Jury of 12 In Judge Morrow's department of the Circuit Court, on a second charge of having sold beer without a liquor li cense from the city. It is charged that he sold to Mr. Mackey, proprietor of the Valley cafe, at Second and Main streets, two bottles of beer on August 25, Henry Uoetz, a bartender, and two women be ing with Mackey at the time. This was the occasion of a raid upon the Del roonloo by Joe Klenlen, a plain-clothes policeman. Klenlen testified yesterday afternoon that Special Policeman Ed Maher told him that he was in the habit of receiv ing cash from Johnson for "special pro tection," as Klenlen expressed It. Klen len admitted that it was after these payments ceased that he raided the Delmonico at the instance of Police Captain Slover. He told of having had a conversation with Maher about the money payments on Johnson's part as long ago as In 1905, when Johnson was conducting the West Coast oyster par lors. Another conversation took place a short time before the raid was made. Klenlen was asked whether he told Captain Slover he would "get him," meaning Johnson, and said that he did, and that he "intended to get him if he continued to violate the law.'' Johnson was operating under a Government li quor license permitting wholesale busi ness, but a license had been refused by the City Council. Further questioning of Sergeant Klenlen brought out that while John son was conducting the West Coast res taurant a complimentary dinner was given for him and Tom Kay by John sond. Klenlen said that he offered to pay Johnson, but that Johnson would accept nothing. Objection to this testimony by Dep uty City Attorney Sullivan brought out the statement from Attorney .Seneca Fouts that he desired "to show the ani mus of this thing." "These officers pounced upon Johnson as soon as he failed to keep up his con tributions to Mackey," said Mr. Fouts. Klenlen began then to narrate how Johnson once tried to "fix" Maher's tes timony In the Municipal Court relative to two young men who were arrested In the West Coast restaurant In 1905. "That was while I was patroling the beat," said Klenlen. Fouts refused to pcvmit Klenlen to continue with his "testimony, Judge Morrow upholding him in his objections. One of the special veniremen sub penaed for the Johnson Jury was Mc Klnley Mitchell. When Deputy Sulll-i van discovered the situation he asked that Mitchell be excused. Attorneys Fouts and Idleman objected, as Sulli van already had exhausted the three peremptory challenges allowed him by law. The law provides, however, that In the discretion of the judge further challenges may be allowed, and after bearing both sides In private. Judge Morrow excused Mitchell. A movement has been started by Lew lston poultrymen to organise a branch of the American Poultry Breeders' Asso elation and assurances of the necessary charter members have been secured.
