The annua! report of Admiral V. L. Capps, Chief Constructor of the Navy, is very large ly devoted to a review of the controvert- over the plans of the battleships North Dakota end Delaware. Admiral I'apps disposes of various phases of crit icisms that have been made of the plans by declaring that the recommendations for changes made by the Newport con ference related only to minor details over which there naturally would be dif ferences of opinion and Improvement from time to time. Estimates for the conference and re pair of vessels at navy-yard? and on foreign stations amount to JS.SW.713. an Increase of JS40.71.1 over the appropria tions of the current fiscal year. The amount estimated for construction and machinery of new vessels authorized by Congri-ss Is tl4.540.7W. the amount ap propriated for the current fiscal year be ing Ill.SK.Mi For continuing work on submarine torpedo-boats, the construc tion and limit of cost of which already have been authorized by CongreES. an estimate is made of Sl.SuO.OOO. the amount appropriated for the current year being J3.O0.0u0. For work on the two fleet colliers heretofore authorized the esti mate is $ilflO.0u0. the appropriation for the current fiscal year being $1,500,009. Embarrasses Work. Admiral Capps refers to the lack of adequate working facilities at many of the naVy-yards for ships under repair and says this condition continues to em . baxrasa the Bureau and prevents the prompt and economical performance of work. A strong recommendation is made In ' favor of limiting the extent to which old .vessels are modernized. CHICAGO. Dee. 2. Efforts on the part of the bull clique of produce men to ad- ! vance further the price of butter will encounter vigorous opposition from con sumers in general, dealers say. and It is possible the Federal authorities will take ', action in the matter. The suggestion that the Sherman law might apply to this case was commented upon by United States District Attorney Sims, who said that although the Federal authorities had never, to his-knowledge, investigated combines seeking to control , the butter market, the anti-trust statute . was framed to protect the consumer from unjust conditions. , "If a conspiracy in restraint of trade. affecting interstate commerce. were ' shown to exist, it undoubtedly would be suppressed promptly by this office or some other branch of this Government," ' said Mr. Sims. The personal clement In politics, said Herr Lede bour, was the national accompaniment of a sham, constitution. Police Chief Fatally Injured. RIVERSIDE. Cal.. Dec. I. Captain W. B. Johnson, Chief of Police of Riverside, accidentally shot himself at noon today with a 44-Colt's revolver. Inflicting a probable fatal Injury. Captain Johnson was chopping wood In his backyard when the heavy revolver fell from his pocket to the ground and was exploded. He Is about 8 years of ago and a prominent resident of Riverside County for :o years. Mrs. Rustin and Hannah Dineen. a ser vant In the liustin home, were the principal witnesses In the trial today of Charles E. Davis, charged with the murder of Dr. Frederick Kustin. Mrs. liustin had little difficulty in parrying the severe cross-questions of Mr. Gur ley. who forced her to identify Insur ance policies on her husband's life, which were incontestable In the event of the person insured committing suicide. Miss Dineen, however, lost the com posure which characterized her testl many at the Coroner's Inquest and pre liminary hearings and all but collapsed during the direct examination by State's Attorney English, and the ses sion of court was suspended ten min ute until she recovered. Miss Di neen's testimony closely corroborated that of Mrs. Kustin. and in addition she testified to having sen a man who resembled the defendant standing near the Rustin home Just before mid night, when she returned from a visit to her sister. Kustin DM X'ot Shoot Himself. Technical testimony was given by Dr. W. R. Lavender, who performed the autopsy on Dr. Rustin'a body. De spite the efforts of Davis' counsel. Dr. Lavender was permitted to give ex pert testimony, during which he ex pressed the opinion that the shot which killed the physician was not self inflicted. The courtroom was filled to suffocation bv a crowd that expected to see and hear irs. Abbie Rice. She will not give, her ti'ftlmonv until tomorrow. Dr. Millard Langfeldt. who was a neigh bor of Dr. Rustin. and was called by Mrs. Rustin goon after the shooting of her hus band, testified that the call came approx imately at 20 minutes to 4. He said that, although he had never heard her speak before, he received the impression that it was Mrs. Rustin talking. He could not account for the impression: Wife's Statement to Doctor. After describing the condition In which he found Dr. Rustin, he said: "I asked Mrs. Rustin, 'How did this happen?' and she answered that she heard a shot and found her husband outside. Nothing further was said on the sub ject." During cross-examination the defense tried-to bring out that from motives of delicacy the witness refrained from in quiring into the circumstances of the shooting at the time, but the objections of the prosecution were sustained. A question aa to whether the wound could have bean self-inflicted was also ruled against. Colfax Lead9 Shoot. COLFAX. Wash.. Deo. 2. (Special.) The Postal rifle match between the Col fax Riflle Club and the Frankfort, Kan., team, is a close race. The third week's shoot gives Colfax a lead of only 13 points. The match is for five weeks. 50 shots a week, five men on a side. The totals for three weeks are: Colfax. 1S: Frankfort. 1300. F. A. Ireland, of Colfax, leads with 284 out of a possible 300.
