THE MORNING OREGOXIAN, TUESDAY, JUNE 23, 1908. ll FIXES THE BLAME Commission Says Motorman Caused StreetcarWreck. EXCUSE IS NOT BELIEVED Tale of Fractious Horse Thought to r Be Invention of Imagination of Married Man Has Been Dis charged by Company. Inauiry was made yesterday by the Railroad Commission Into the wreck of two cars Sunday on the O. W. P. lin and the injury of a score of passengers. Commissioners Aitchlson and Campbell held an investigation in the offices of Mr. Aitchlson, 306 Couch building, and fixed the responsibility for the smash on Mo tnrman B. F. McDousal, who was In charge of the eastbound train on the Mount Scott line that crashed into the westbound train at Archer Place. Superintendent G. C. Fields, of the Ore gon Water Power lines, was before the Commissioners and gave facts brought to light by his Investigation to fix the responsibility for the wreck. It was the opinion of Mr. Fields that the motorman alone was to blame. Ho said the man had already been discharged because of his negligence. Superintendent Fields testified the accident was plainly caused by the motorman running past a block signal that was set against his train and that had he been attending to business he could not have failed to notice the warning semaphore. The motorman maintained . to officials of the company that be was not flirting with a girl at the time he ran past the ilock signal, as has been started by eye witnesses to the wreck, but that he was watching a fractious horse that was giv ing its driver a great deal of trouble. As the horse was apparently frightened by the car, his attention was attracted to It because he was engaged In getting his car past the animal without causing a runaway. This story is not believed by Superin tendent Fields, who regards It as the tale of a married man caught flirting with a girl. The Commission appeared to take it with a grain of salt as well, and, al though no formal report was made on the wreck by the Commissioners who at tended the hearing, it Is believed that such a report, when made, will fix the responsibility on the negligent motorman. Motorman McDougal also called at the office of The Oregonlan and denied the charge of flirting. The investigation occupied a large part of yesterday afternoon, ana as the Com mission was satisfied as to the cause of the accident from the statements made by spectators of the wreck, no extended inquiry was considered necessary. Escapes Demurrage Law. Application was made to the Oregon Railroad Commission yesterday by the Oregon Electric Railway Company for the suspension of the act known as the Reciprocal Demurrage law; providing penalties for railroad companies which do not provide freight cars for ship pers within a specified time. The rail road company made the showing that as yet It is not equipped with enough freight cars to handle freight business on its lines, and until such equipment Is provided, it cannot meet the terms of the reciprocal demurrage law. Com missioners Aithchison and Campbell, who heard the petition, granted a term of 30 day during which the law will not be enforced against the Oregon Electric. Within that time, it is ex pected by the management of the sys tem to have a sufficient supply of freight cars to meet all requirements, as a large number of cars have been ordered In the East. They will be de livered within the next few weeks. Vice-Presid4it Miller to Come. Darius Miller, first vice-president of the Chicago. Burlington & Qulncy, will reach Portland this morning in his pri vate car. He is coming here from Den ver over the Union Pacific and O. R. & N. Mr. Miller is understood by local railroad men to have a few officials with him, but who they are Is not known here. Vice-President Miller Is a very prominent railroad man, who is known throughout trafflo circles in America. He was formerly general traffic manager for the Great Northern, but James J. Hill placed him In his present position when the Burlington came tinder Hill control several years ago. Chief Engi neer Darling, of the Northern Pacific, wno is aireaay in tne city, will meet Mr. Miller here. Northern Pacific Again. The Northern Pacific Railway re sumed traffic on all its lines vester day, after being blocked for some time by floods in Montana. Not only pas senger business but express, perishable ireignt and all other freight traffic was accepted at the local offices yes terday, and was given quick dispatch through to the East. The line has Been put in such good condition that no rurther trouble is anticipated. $2000 FOR SHORT STORIES Sunset Magazine is offering 12000 in prizes for stories.
