BARONS POCKET MILLIONS Timber and Stone Act, Under Which Land Is Disposed Of, Will Not Be Repealed Before the Present Session of Congress Ends. OREOOJilAN NEWS BUREAU, Wash ington, Mar 14. It is very evident that Congress does not propose, at the pres tnt session at least, to repeal or modify the timber and stone act. It Is there fore reasonable to expect that Secre tary Garfield, soon after the adjourn .ment of Congress, will carry out his present Intention of modifying, the regulations for enforcing that law, so as to require tlmbermen hereafter to pay the appraised value for lands taken under this law, no entry to be made for less than 12.50 an acre. This all comes about from a careful study of the timber and stone act, something that never occurred dur ing the administration of Secretary Hitchcock, who loudly denounced the unfairness of the timber and stone act, but never awoke to the fact that he had it In his power to correct the In justice. Heretofore the Interior De partment haa hastily read the timber and stone act, and interpreted it to mean that Government timber land shall be sold at a flat rate of 12.50 per acre, regardless of its value. Mr. Gar field, however, has discovered that the law does not fix a flat rate on timber land, but provides that such land shall be sold in tracts not exceeding 163 acres to one person, "and the minimum price thereof shall be J2.50 per acre." According to Mr. Garfield's contention, if Congress had intended that all tim , ber land should be sold at 12.50 per acre, It would have so stipulated, and not used the language just quoted. He .contends, and many of the officials of his department agree with him, that the law clearly intended that a higher price should be exacted when the De partment believed a higher price, was Justified. Hitchccck Telia of the loss. The fact that Secretary Garfield contemplated making a change in the. administration of the timber and stone act was brought out in the debate on the sundry civil appropriation bill in a speech by Mr. Hitchcock, of Nebraska. Mr. Hitchcock was explaining to the House the heavy losses sustained by the Government by reason of improper administration of the timber and stone law, when he disclosed the purpose of Secretary Garfield. He said: This Houee ourht to know that for many years there has been in the Interior De partment a gross misrepresentation of this law, under which many millions of dollars' worth of publio timber has been practically thrown away. The use of the word "min imum" in that law obviously meant that hljrher prices should be charged for the more valuable land. This nas. however, never been done. Under the present ad ministration nearly 8,000.000 acres of those valuable lands have been sold at S2.50 per acre. That price yielded the Government less than $18,000,000, whereas the Interior Department admits now that the real value of the lands was over fSO.000.000. The de partment has disregarded the limitation and proceeded to sell all forest lands, hew ever valuable, at $2.50 per acre, and in no cava has a higher price been demanded. I have before me the opinion of one of the legal advisers of the Department of the Interior, admitting that the department has Just discovered the word "minimum" in the law, and that hereafter it proposes to change its policy and require of. pur chasers under the timber and stone act a higher pries than fi.so. an acre when tha value Is greater. Failure properly to ad mlnlKter this law has cost the Government In the past seven years alone at least $60. 000.O0O. Ex-Secretary to Blame. Wltnout specifically .alluding to ex Secretary Hitchcock, Congressman Hitchcock (who Is no relative of the late Cabinet member) said that It was well known tn tha Department that many quarter-sections of timber land on the Pacific Coast, worth easily $10,000, had been sold with Secretary Hitchcock's approval for the nominal price of $400. He condemned Secretary Hitchcock for making such sales and permitting these valuable iands "to pass Into the hands of the lumber .trust, which has been selling Its lumber to the people of the United States at an advance of 70 per cent in the last ten years. "It Is a scandal," he added, "that our valu able timber lands in the Pacific Coast States have been sold at the lowest price, when Congress intended to pro vide that they should be sold some where near their actual value. This the Department now admits." Following the statement of Repre sentative Hitchcock, Congressman Mon dell, of Wyoming, chairman of the public lands committee, virtually noti fied the House that the timber and stone act would not be repealed, and he then voiced his personal belief that timber lands should continue to be sold for $2.50 per acre. Any attempt to change Departmental regulations, as proposed, ho said, would put a stop to sales of timber lands, and these lands would then be taken up under the homestead law, and the Government be deprived of the $2.50 per acre It now receives. Mondell Opposes Change. Mr. Mondell said it was his opinion that Congress Intended all timber lands should be sold for $2.50 an acre. He discredited the statement of Mr. Hitchcock that any quarter-section of timber land had been worth $10,000 when sold. "The fact Is." said he, 'that 90 per cent at least of the lands . that have been sold under the timber and stone act were worth at the. time they were sold little more than $2.50 an acre. I have personal knowledge that many tracts sold at this figure are not really worth, $2.50 an acre. While we unquestionably did sell some valuable lands on the Pacific Coast for $2.50 an acre, ordinarily, when sold, they were far distant from market, and only the construction of expensive lines of railroad made them valuable." Mr. Hitchcock interrupted to say that these railroads had not been construct ed to benefit the poor settler, but to accommodate great lumber companies which have In the past seven years ac quired most of the S.000.000 acres en tered In that time under the timber and stone law. Mr. Mondell replied that this timber land had to be held in large areas In order to be developed. Con tinuing his argument. Mr. Mondell said that In the main timber lands sold by tho Government were not worth a great deal above the Government price. At present practically all of the valu able timber lands are in forest re serves. The timber and stone act is at this time taken advantage of In nine cases out of ten by the settler to acquire a tract of rough, broken lud lying adjacent to his farm, which. In the majority of cases, is not worth more than $2.50 an acre." This again brought Mr. Hitchcock to hid feet with a statement furnished by the Interior Department, showing that contrary to Mr. . Mondell's conten tions, the timber land sold in the past seven years was worth on an average $10 an acre. He further stated that val uable timber entries have been made In very recent years, and transferred to large lumber companies. Mr. Mondell added: . Homestead Law Precludes Raise. -The timber and stone law now applies almost exclusively to sparsely-settled tim bered lands. I hope that as to the few acres of broken, rocky, scrub timber land remaining outside of forest reserves, the department does not propose at this late day to raise the price. If they do. It means simply perpetual Federal ownership of every pleoe or scrub timber and every rocky hill side throughout the entire public domain, the perpetual retention of those lands In public ownership, paying and contributing nothing to the support of the communities In which they He. and necessarily constant ly open to depredation by all comers. The proper procedure is to continue to sell these lands at $2.50 an acre. 1 have no hesitancy in saying .that the land en tered during the past seven years, under the timber and stone act, had no such value, or anything like such value, as sug gested by the Interior Department. If the price of timber lands Is now to be raised. fctoe really valuable timber lands, if such .there be. would be homesteaded rather than purchased, so that tbs Gov ernment would be making a spectacle of Itself by giving away lands under the home stead law for nothing, or under the com mutation clause of the homestead law at $1.25 an acre, which were not adapted to cultivation, but which were Intended to be sold at $&trO an acre. Certainly the offi cials of the Interior Department do not Im agine that with the present homestead law oq the statute books they could get any considerable price for the remaining timber lands on the public domain If there were any of any considerable value. Committees of Congress have discussed this matter many times and declined to favor changes In the law. The -use of the word "minimum" has also Been noted, but no one, so far as I know, has ever sug gested that the law Intended anything dif ferent from w-hat It says, to wit, timber and stone lands shall be sold at the mini mum .price of $2.50 per acre; in other words, at f 2 V an acre. CATHOLIC FORESTERS ATTEND STREET FAIR IS A BODY. Ball Given In Honor of Guests. Dancing; Attracts Many, but Side shows Are Well Patronized. CARNIVAL VOTING CONTEST. The fourth night of the carnival and street fair being given at Williams ave nue and Morris street by the Catholic Young Men's Club of Albina attracted a larger crowd than on' any previous night. The cause of the unprecedented attendance was owing to the night hav ing been set aside for the benefit of the Catholic Order-of Foresters; who attend ed the affair in a body. The feature of the programme last night was the handsome ball given in honor -of the visiting guests, who assem bled In the large auditorium of the Cath olic Young Men's Club, and to the strains of a well-balanced orchestra, engaged in dancing for a goodly portion of the night. Aside from the dance the many side shows and. attractions came in for their share of patronage, for the running fire of comment spieled by the barkers gave things the semblance of -real country fair and carnival combined. The dog and monkey show, wherein some 20 grotesquely ' decorated clowns cavort, proved a source of delight to the little ones, and it might even be said that the grownups were not slow to rec ognize the call of their younger days. The plantation singers down at the end of the "Trail" came in for their share of the public favor and the throngs is suing from this tent after each per formance wore smiles of the sort which refuse to be banished. Tonight the St. Joseph Society will have Its inning at the carnival, and the Germans can -be depended upon to make things hum in the immediate vicinity of the country store, where Andy Wein berger, who, ,lt is reported, will change his nationality on Hibernian night, holds forth in the most genial and liberal man ner. F. T. MERRILL EXPLAINS Kented Hall Because Mayor Sanc tioned Emma Goldman Lectures. Fearing that his action in leasing his hall for the lectures fo toe given Sunday by Emma Goldman, the Anarchist, would be misconstrued, Fred T. Merrill last night made the following statement: "A young man called upon me at my office and asked permission to rent my hall for Sunday afternoon and evening. I Inquired of him why he did not seek some other halj more' suitable for the purpose, which, he had explained, was for the lectures to be given in Portland by Emma Goldman. He replied that he had been sent to me by C, E. 9. Wood, who had rented the T. M. C. A. Chapel, but desired the use of my hall as the Association desired to cancel the con tract. "I told the young man to tell Mr. Wood to call me up later and I would let him know. 1 then telephoned to Mayor Lane and asked him if it was his - intention to permit Miss Goldman to speak in 'Port land. To this question, the Mayor re plied: 'Yes. This Is a free country and free . speech is always permissible. As long as Mlsa Goldman con tines her utter ances within reason and advocates no inflammatory ideas, she will not be mo lested. At 6:30 o'clock, Mr. Wood called me up and I Informed him that he could have the hall. "This does ,not mean that I believe in the doctrines of Miss Goldman, or that I would permit her appearance here in public were I the Mayor. The young man who called upon me, wished me dis tinctly to understand that Miss Goldman was not as bad as she had been painted and that she was quite refined In her de meanor. If Miss Goldman Is to be per mitted to speak in this city, she might as well use my hall as any other." - LIFE SAVED BY -A COIN Bullet Fired- at Boy Flattens Against a Hollar. PARAGOULD, Ark.. He became in volved in a dispute with a desperate negro who shot at him and would un doubtedly have killed him had not the bullet flattened against the coin.
