The trial of Frederick A. Hyde, .lohn A. Benson, Henry IV Pimond and Joost Schneider, who are charged with a conspiracy to defraud the Government out of valua ble land, is punctuated with numerous objections from the attorneys for the defendants to evidence which the Gov ernment is endeavoring1 to introduce. The principal objection thus far has been that the allowed illegal acts In regard to wb ich w itnesses have testi fied occurred more than three years prior to the finding of the Indictment In 1904. and are therefore barred by the statute of limitations. While United States District Attorney Baker has se cured thp admission of the evidence thus far. a hard lejcal battle is expected when fie final arguments are heard on the motion t.j strike out all evidence of this character. The w itnesses today w ere George C. Brown, of the Oregon State 1-and Office; Thomas McCusker, of Portland. Or., and lon Alexander. Mr. Brown testified as to the methods prescribed by law for the purchase of school lands in Oreeon. He said there was no law limiting the amount of such landf that one man may acquire by assignment. Mr. MeCusker testified that he had been engaged by Schneider, one of the defendants, to aid him in securing; ap plications for school land in Oregon from persons having1 the right to pur chase an allotment of such land. Upon receipt of an assignment of each appli cation to Schneider, the witness said, 3 was paid to the applicant. The appli cation called for 30 acres, and the assignment usually was made at the time the application was signed. The Government brought out the fact that the applicant did not pay for the land before assigning it to Schneider. In addition to the Portland- Seattle game, the East Side High School met and defeated the Hill Military Acad emv nine In the regularly scheduled In terscholastle League contest. The score was 8 to 4. It would be hard to say which game attracted the greater atten tion. for the rooters for the Kast Side Hill Military contest made just as much, If not more noise, than did the West Siders during their victory over the Seat tle lads. The Seattle boys played a fine game, and In spite of their defeat, are deserve ing of considerable praise. The defeat of Hill Military by the East Side High was due principally to the wildncss of the cadet pitcher. Mays, who started the game, hut was succeeded by Merchant in the fifth Inning. Portland wrestling- fans are inclined to believe that Dr. Roller will have a full night's work on his hands when he tackles Victor McLAglen, the big English wrestler -whom he is sched uled to meet at the Helllg Theater to morrow night. McLaglen arrived in Portland yesterday from Tacoma. and the sports have had a good chance to size him up. He is as big as a whale and as strong as a lion, and If he does not give the Seattle crack a good time of it. it will not be becanse he lacks anything in the matter of strength. McLnglen will tower over Roller fully three luches. as he stands six feet three in his stockings, while the doctor Is six feet flat. In weight Mrtaglen will have an advantage of fully 20 pounds, an Important factor In a wrestling- match. The Eng-llsh Her cules will also have a long ways the better of it in youth and strength. Roller is past 32 years of age, while McUaglen is just 11 years younger.
