Tn passing upon routine matter yester day afternoon the Port of Portland Com mission appropriated several thousand dollars for Improvement of Its equip ments. About 1000 feet oX shore pipe will be purchased for use In making the East Side fills and a first-class pump for fire protection -will he Installed on the dredger Columbia. Mr. Boise said tho dredger was dolng'flne work, and to make It- still more efficient, a telephono lias been Installed so that a man at tho end of the pipe can keep the engineer or the dredge thoroughly posted as to how well the pump and digger are doing. This will overcome the possibility of pumping clear water at times and thus avo much time and a great deal of expense. Henceforth .steamers towing log rafts will have to proceed cautiously when passing any of the dredgers at work, as the Commission has discovered that there are ample laws to collect for damages accruing from the swells caused by the steamers when notified to proceed with care. The .superintendent was instructed to keep a record of the boats that cause damage in the future. Two United States Marshals arc still being kept on board the dredcer Colum bta and the tender John McCraken. and the Port will Invoke the aid of Its law yers to learn whether they are entitled to remain there or not. They were placed on board as a result of a libel suit having oeen brought by the United States Gov rnmcnt for J1C.000 damages alleged to have been caused "by the sinking of the lighthouse tender Manzanita, which col llded with the dredger several months ago in tne vicinity of westport. More Trouble Takes Place on North Bank Between Hill and II a r rlman Graders. Reports from Stevenson. Wash., rtate that rifles figured In the conflict for rights of way between the Portland & Seattle Railway and tho Columbia Valley Rail road yesterday at 'Cook's Landing, when a party of Hill graders maintained pos session of a. bunkhouso by menacing an opposing party of Columbia. Valley labor ers with weapons. No uhots were fired and no arrests were made "Whllo occupying their bunkhouse, the Portland & Seattle crews are said to have been notified by Columbia Valley men to vacate the building, as It was claimed to be on the property of the latter company. Tho Columbia Volley graders Installed their blankets in the building: pending tho removal of the effects of the Hill graders. Later the Portland &. Seattle gangs thought better of their determina tion to move, and when the demands were repeated, met their opponents with rifles. Tho claims of the Harrlman forces were not Insisted upon under the circum stances, and the Hill laborers threw out tho blankets of tho Columbia Valley gangs ana maintained possession. Elsewhere the situation on the north bank is said to have been peaceful yes terday, notice of several new suits to condemn rights of way across property owned by the Columbia Valley were given counsel for tho latter road by Hill attor neys. To all these suits the same general answer will be made that as one railroad already owns the property and requires it for construction purposes, another road cannot interfere with it by acquiring con flicting rights. Men and equipment are being forwarded to th Columbia Valley camps. Dump cars and construction materials ore being dispatched almost every day. Twenty men were sent out yesterday to Collins Springs, and 20 more left for a point op posite Rufus. GOVERNOR IS UPHELD Pcabody Legally Imprisoned Moyer, Says Supreme Court. DENVER. April 13. Chief Justice Gabbert of the State Supremo Court has filed a supplemental opinion in the Moyer case. It Is generally con ceded that this new opinion will take precedence over the former majority opinion as the latest expression of tho court. Tho Chief Justice declares that the Governor of the state has the power to suspend habeas corpus at his discre tion, and that the courts cannot re view the action. The body of tho new opinion is taken up with excerpts from an opinion of Justice Johnson in a case in the Philippine Islands in which the power of the Governor-General to suspend the privileges of the writ of habeas corpus during a stato of In surrection in the Province of Batangas wa upheld. The Chief Justice finds the case anal ogous to the situation presented in Colorado during the labor troubles. and draws conclusions in which the incarceration of Charles 1L Moyer by the military is upheld. Go to Court of Appeals, Too. Congressman J. X. "Williamson will fight his case out before the Circuit Court of Appeals, as well as before the United States Supreme Court, if proceedings be gun yesterday are carried to completion. Following upon his writ of errors In tho appeal to the Supreme Court, yesterday. lie, together with Dr. Van Gesner and Marlon R. nes. tiled an assignment of errors in an appeal to the Circuit Court of Appeals. The writ was allowed by Judge W. B. Gilbert in all three cases. The assignment of errors made by Wil liamson is identical with the one filed in taking the case to the Supreme Court. Those of Gesner and BIcRs differ Mightly from It. Leo FrJedo and Ben Allen fur nished $2000 bonds for Gesner. and Allen and IL Taylor Hill furnished bonds of the same amount for Biggs.
