Heo. 3. And be it further enacted, That tlie ttuid HtiHo
of Colorado nliatl consist of all the territory included
within the following boundaries, to wit: Coimrtenviutf

tude west from Washington; extending llioneo due
west along caid 3Ttb degree of north latitude to a

along said 3'd degree of went longitude to u point
formed by its intcreettou with the 4 tt degree of
north latitude; thence due east along nid 41st degree
. of north lalitude to a point formed by Its intentrctinn

ington; thenrd due south along sutd .Hh degree of
west iongitnde.
Bee. 3. And be it it further enacted, That all persons
qualified bv law to vote for representatives to the gen
eral assembly of suid territory, nt the date of the pas
Inge of this act, shall be (juulilicd to bo elected; and
they are hereby authorized to vote for and choose rep
resentatives to form a convention, under such rules
and regulations as the governor of said territory may
prescribe; and also to vote upon the acceptance or re
jection of such constitution as may be formed by said
convention, under such rules and regulations us said
convention way prescribe; und if any of said citizens
are enlisted in the army of the United Suites, and ure
still within said territory, thoy shall be permitted to
vote at their place of rendezvous; und if any are ab
sent from said territory, by reason of their enlistment
lu the ui myof the United Stated, they shall be per
mitted to voto at their place of service, under the
regulations in each cane to be proscribed, as aforesaid.
And the aforesaid representatives to form tho ufore
said convention shall bo apportioned auiong the sev
eral comities in said territory in nroportieu to tlie pop
ulation, as near as may be; and said apportionment
shall be made for said territory by the governor, Uni
ted Stales district attorney, aud chief justice thereof,
or any two of them. Aud the governor of said terri
tory idiall, by proclamation on or before llid first Mon
day of May next, order an election of tho representa
tives aforesaid, to be held on the first Monday in June
thereafter throughout the territory ; and such election
shall bo conducted in the same manner as is prescrib
ed by tlie laws of said territory regulating elections
therein tor members of the house of rcprt;MeulittiveH;
and the number of members to said convention shall
bo the same as now constitute both branches of tlie
legislature of the nforosaid territory.
Hoc. 4. And be it fun her enacted', That (tic members
of the convention, thus elected, shall meet ut the cap
ital of said territory on the first Monday in duly next,
and, after orgttui.atiou, shall declare, on bchatf'of tho
people of said territory, that they adopt the roubtitu
tion of the United 8tates : whereupon the said con
vention shall be, aud it is hereby, authorized to furiu
A constitution and state government for said territory):
Provided, Thut the constitution, when toiuied, shall
be republican, aud not repugnant to the coiiMtitutiou
of the United States aud the principles of the Uechtra
tiou of Independence ; And provided, further, That
said convention shall provide, by an ordinance, irrevo
cable without the con sent of the United dtules und
the people of said state :
First. That there shall be neither slavery nor invol
untary servitude in the suid slate, otherwise than in
the punishment of crimen, whereof tho purly shall
have been duly convicted.

Third. That the people inhabiting naid territory do

ted Htates, und that the lands belonging to citizens of
the United fetutes, residing without the suid slate,
shall never be tuxed higher than the land belonging
to residents thereof, and that no taxi s shall be imposed
by suid Blate on hinds or property therein Ix-longing
to. or which tuuy bereuttur be purchased by, the Uni
ted Statea.
bee. o. And belt further enacted, That incase a
coubtilutiou and Blate government shall be formed for
the people oi said territory of Colorado, in compliance
wiib the 1'iovinioiin of this act, that said convention
forming the same shall provide by ordinance for sub
mitting suid constitution to the people of xuid slate
for ibeir nitilication or rejection, at an election to be
held on the second Tueadny of October, one tliousand
eight hundred and sixty-four, ut such places and under
such regulations us may be prescribed therein, ut
which election Iheluwlul voters of said now slute
shall vote directly for or against the proposed cousii
tution ( and the returns ot said election shall be made
to the acting governor of the territory, who, with the
United btates diatriet attorney und chief justice of the
aid territory, or any two of theui, shall cauvasa the
samo, and 11 a majority of legal votes ..hull be cast for
said constitution in said propesed stale, the said acting
governor shall certify the same to the President of the
United Suites, together with a copy of said constitu
tion and ordinances to that ellect ; whereupon it shall
be the duty of the President of the United Htates to
issue his proclamation declaring the slute admitted
into the Union on tn equal tooling with the original
states, without uny further action whutever on the
purl of congress.
Bee. G. And be It further enacted. That until the
next general census shall be taken said slute of Colo
rado shall be entitled to one represeututivo in the
house of representatives of the U uited Slates, which
representative, together with the governor and slute
and other o Ulcers provided for in said constitution,
may be elected ou the same day a vote is Ukun for or
against the proposed constitution and state govern
ment. bee. 7. Aud be It further enacted, That sections num
bered sixteen and thirty six, in every township, aud
where such taction have been sold, or oiliervite dis
Iiosed of by an act of Congress, other land cqniva
ent thereto in legal subdivisions of not lexs than one
quarter section, and as, contiguous as may be, shall be,
and are hereby, granted to suid slale for the support
of common schools.
Hue. 8. And bo it further enacted, That provided the
state of Colorado shult be idmiilnl into the Union, in
accordance with the foregoing provisions of this act,
that twenty entire sections of the unappropriated
public Isnds within said state, to be selected and lot a
U-d by diieetion of the legislature thereof on or before
the first day of January, onno Domini eighteen t un
dred aud iixty-eighl, shall be, aud they hereby, gian
ted in legal subdvisious of not less thun one hundred
aud sixty acres to suid stato, for the purpose of erec
ting public buildings at the capital of said slate for
legislative and judicial purposes, in such maimer as
the legislature shall prescribe.

Hoc. U. And be it further enacted, That from and
after the Rddmisslou of the said state of Colorado into
the Union, in pursuance of this act, the luws of the
United Mutes not locally inapplicable shall have the
same force und ellect within the said state as else
where wilhin the United Htates, ami suid slulo sluill
constitute one judicial district, aud be called the dis
trict of Colorado.

Htates, or any minister, consul, or commercial agent

Hee. & And be It further enacted, That upon the en
try of every steamer or sailing vessel from any foreign
fiort the master er commander thereof shall make re
urn, on oath or Rllirmalion, showing that be has
promptly deli vored at such foreign port or porta all
mails puued on bousd of tho sleaiuor or vessel under
hie command before clearance from the United Htalea.
And iu case the master or commander shall full to
make oath or atlirtnaiion as aforesaid, showing thai
he bass delivered ttie mails placed on board his steam
er or vessel iu go4id faith, the said steamer or vessel
shall not be entitled to tlie privilagoe of a steamer or
vessel of the United Htates.
Her. 3. Aud be it further enucled, That the Postmas
ter General be, in id Is hereby, authorised to make
contracts, to continue noi tx coed tug four years, for
the transportation of all mailable matter other than
letters, and of such letters as may be so directed, by
the Isthmus of Panama or the Nicaragua route, or
both of them t Provided, Thai the expenditure for
tho service shall uot exeeeed one hundred and sixty
