Yon mitke two poftitu : 1. That the deduction nf income from sources named in Section Ul, itn which a tax nf three fier cent, hat been aln-ndy paid, ii to he mado n nsccrtniniriir the amount of taxable income nd the rate of lux thereon, and ii to be ex cluded from all further computation. 2. I think yon have not fully weighed the pro. Tislons of the law, or iti manifest intent. Previous sec tions of the law impose a tax of three per oent. ' on payments of interest and dividends by spec- Wed corporations, on salaries of V. 8. officials ! and on income derived from advertisements. Section 01, in its first olnuse, provides "that in estimating said annual gains, profits or incomes i whether subject to a duty, as provided in this Aot of three per centum or five per centum, all other National, State and local tuxes . shall be first deducted.'' In its second elntue, it provides that salaries or payments from the United States, and interests or dividends from hanks and i tiler corporations, and income from advertisements, "upon tyhioli specific, stamp or ad valorem duties shull have been assessed or paid, shall also be deducted.'' You bold that all the income from all these sources shall be first deduoted in determining the taxable income and rate of lax. I cannot see that the law justifies your opinion. It cer tainly does not so provide in term.. The OOtli section gives to every person residing in the United States an absolute deduction' of $000. The 61st section gives him an absolute deduc tion of other mitiunal, Statu and local taxes paid by him. The 11th section or the Act of of March 3. 1803, as if to make this distinction . more emphatic, provides that in estimating the annnal gains, profit, or income of any perron tinder the tat to which this not is an amend ment, the amount actually paid by such person for the rent of the dwelling house or estate on which he resides shall first be deducted from the gains, profits or income of inch person. - Toil office hus a I wo authorized as by the equity of statute, a deduction in this as in all Cases, of necessary repairs, etc., upon the prop rty vlelding the income. There ii one other consideration which bears heavily against your construction. Congress imposed a duty of one and a half per cent, mi that portion ol income is not named iu Section 61 among those In be deducted. Your construction must be wrong, or Congress has failed to do what it manifestly, nud iu the clearest luu. gunge, iuteuded. The construction of this office is natural and reasonable. It IS itiliarmoiiy with the general scope of the luw. It is reasonable, in placing upon one footing all residents of the United States whose taxable Incomes are over 110,. 000, whether they be olHve bolder, tnerchuins, manufacturers, bunkers, farmers, or wealthy men of leisure. It is further reasonable in maintaining the brondlintinction of rate ci- rvssly enacted lu section IK), and Id bat mim ing that with tlio merely directory provisions of section 01. When) taxable Inconio is ascertained to be in excess of $10,000. it becomes liable to five per cent, tax, and must be made to bear it, whatever it sources. If some of them hate already paid three per cent, at the hands of corporations paying interest or divideuds or utlt-. erwise, two per cent, oddilioual nuLt be im posed upon them as necessary iueaus,jiud the only practicable means, of carrying out the mandatory provisions of the law. Johnson, Senator from Georgia in the rehel Congress, iu defense of a bill which he introduced luet winter, providing an aiueiidnient to the coiisijtution of tlio Con federate States. The amendment proposed to incorporate the doctrine of secession into the Confederate constitution, so that there could bo no doubt about It in future. It provided that any State being aggrieved by nny act of Congress Hull liy convention declare tlio act to he unconstitutional. Congress shall call a con vention ol the Mates, end if the act is not ap proved by two-thirds of the Statei it shull be void ; but it It is alurnicu, and un adjustment enn be made satisfactory to the complaining State, the State shall, if it clionsc, be allowed to secede in peace. Snroly this seems very reasonable, if the secession doctrine is adopted. It was objected that the amendment wo un necessary! But Mr, Johnson says that the amendment is not in so many words recognized in the constitution, and lie fears that In the fu ture trouble may arise oti this question. He fea'rs I hat Congress niny exceed its delegated powers. He thinks that a convention nf States furnishes a much better arbiter hetwoen n dis contented State and tlio Confederate govern merit than the Supreme Court. He says that the Supreme Court of the United States, at the time of secession, had become so imbued witli t ie party spirit of the day that it was an nn siife umpire between tlio States and tlio United States. Another consideration which, Johnron thinks commend!! his amendment, is that it would put an end to nil Congressional compromises, lie ays that the various compromise! were a can ker upon the U. S. government down to the day o! disruption, and that they were submit, ted to by the South because resistance prom ised war and hloodhid.
