A5 THE DAILY ASTORIAN • TUESDAY, DECEMBER 18, 2018 Judge tells Flynn he can’t ‘hide my disgust’ Sentencing postponed By ERIC TUCKER and CHAD DAY Associated Press WASHINGTON — A fed- eral judge abruptly postponed the sentencing hearing today for Michael Flynn, President Donald Trump’s fi rst national security adviser, after a stun- ning hearing in which the judge accused Flynn of sell- ing out his country. The delay allows Flynn to continue cooperating with the special counsel’s Rus- sia probe and get credit for it in his punishment. Flynn pleaded guilty last year to lying to the FBI about his Russia contacts, just days after Trump was inaugurated. “Arguably you sold your country out,” U.S. Dis- trict Judge Emmet Sullivan told Flynn in a tongue-lash- ing that raised the prospect that the judge could send the retired Army lieutenant gen- eral to prison, even though AP Photo/Carolyn Kaster Michael Flynn arrives at federal court. prosecutors have recom- mended against prison time, citing his cooperation in the Russia probe. Sullivan told Flynn “I can’t hide my disgust, my disdain” at the crime. After a prosecutor raised the prospect of Flynn’s con- tinued cooperation with other investigations in the future, Sullivan warned Flynn that he might not get the full credit for his assistance to the government if he were sen- tenced as scheduled today. Typically, judges like to sen- tence cooperating defendants after their cooperation is done so they can fully eval- uate the help they gave to the government. He gave Flynn a chance to talk it over with his lawyers, and the court went into a brief recess. When they returned, Flynn lawyer Rob Kelner defended Flynn’s coopera- tion — but requested a post- ponement to allow for him to keep cooperating. Flynn, who served as national security adviser for only a few weeks, was to be the fi rst White House offi cial sentenced in special counsel Robert Mueller’s investiga- tion into possible coordina- tion between Russia and the Trump campaign. The hear- ing took place amid esca- lating legal peril for Trump, who was implicated by fed- eral prosecutors in New York this month in hush-money payments to cover up extra- marital affairs. Nearly a half-dozen former aides and advisers — including Flynn — have pleaded guilty or agreed to cooperate with prosecutors. Trump signaled his intense interest in the case by tweeting “good luck” to Flynn hours before the sen- tencing hearing. He added: “Will be interesting to see what he has to say, despite tremendous pressure being put on him, about Russian Collusion in our great and, obviously, highly success- ful political campaign. There was no Collusion!” At the hearing, Sullivan told Flynn that he would take into account his exten- sive cooperation with the government, which includes 19 meetings with investi- gators as well as a 33-year military career that included service in Iraq and Afghani- stan. But he also said he was forced to weigh other fac- tors, too, including Flynn’s decision as national secu- rity adviser to lie to the FBI on the premises of the White House about contacts he had with the Russian ambassador to the United States. Earlier in the hearing, Sul- livan asked Flynn a series of questions to make sure he wanted to move forward with his sentencing in light of a memo his attorneys submit- ted last week that took aim at the FBI’s conduct during agents’ January 2017 inter- view of Flynn. Flynn said that memo notwithstanding, he was ready to proceed with sentencing. WORLD IN BRIEF Associated Press White House pulls back from shutdown threat over wall funds WASHINGTON — The White House today appeared to inch away from forcing a partial government shutdown over funding for a southern border wall, with Press Secretary Sarah Huckabee Sanders saying there are “other ways” to secure the $5 billion in funding that President Donald Trump wants. It was the fi rst sign of a potential White House counter offer as the clock ticks down toward Friday’s midnight dead- line to fund the government. “At the end of the day, we don’t want to shut down the government,” Sanders said on Fox News. “We want to shut down the border from illegal immigration.” Trump’s $5 billion is far more than the $1.3 billion Dem- ocrats have offered, which is not for Trump’s promised wall along the southern border with Mexico, but fencing and other security measures. Sanders pointed to one bill, likely referring to the Sen- ate’s bipartisan appropriation measure for the Department of Homeland Security, which provides $26 billion, including $1.6 billion for fencing and other barriers. It was approved by the committee in summer on a bipartisan vote. A partial shutdown risks disrupting government opera- tions and leaving hundreds of thousands of federal employ- ees furloughed or working without pay over the holiday sea- son. Costs would be likely in the billions of dollars. Trump signs order to create US Space Command WASHINGTON — President Donald Trump launched the Pentagon’s new Space Command today, an effort to bet- ter organize and advance the military’s vast operations in space that could cost as much as $800 million over the next fi ve years. Trump signed a one-page memorandum authorizing the Defense Department to create the new command. Speak- ing at the Kennedy Space Center in Florida, Vice President Mike Pence said, “a new era of American national security in space begins today.” The goal is to set up a command to oversee and orga- nize space operations, accelerate technical advances and fi nd more effective ways to defend U.S. assets in space, including the vast constellations of satellites that American forces rely on for navigation, communications and surveil- lance. The move comes amid growing concerns that China and Russia are working on ways to disrupt, disable or even destroy U.S. satellites. The new order is separate from the president’s much touted goal of creating a “Space Force” as an independent armed service branch, but is considered a fi rst step in that direction. The memo provides little detail on what will be a long and complicated process as the Defense Depart- ment begins to pull together various space units from across the military services into a more coordinated, independent organization. According to one U.S. offi cial, the command would pull about 600 staff from existing military space offi ces, and then add at least another 1,000 over the coming years. The roughly $800 million would mainly cover the additional staff. The costs for the existing staff would just transfer to the new command, but that total was not immediately available. Trump administration moves to ban bump stocks WASHINGTON — The Trump administration moved today to offi cially ban bump stocks, which allow semi-au- tomatic weapons to fi re rapidly like automatic fi rearms, and has made them illegal to possess beginning in late March. The devices will be banned under a federal law that pro- hibits machine guns, according to a senior Justice Depart- ment offi cial. Bump stocks became a focal point of the national gun control debate after they were used in October 2017 when a man opened fi red from his Las Vegas hotel suite into a crowd at a country music concert below, killing 58 people and injuring hundreds more in the deadliest mass shooting in modern U.S. history. The regulation, which was signed by Acting Attorney General Matthew Whitaker on Tuesday morning, will go into effect 90 days after it is formally published in the Fed- eral Register, which is expected to happen on Friday, the Jus- tice Department offi cial said. In an advisory today, Surgeon General Jerome Adams said parents, teachers, health professionals and government offi cials must take “aggressive steps” to keep children from using e-cigarettes. Federal law bars the sale of e-cigarettes to those under 18. For young people, “nicotine is dangerous and it can have negative health effects,” Adams said in an interview. “It can impact learning, attention and memory, and it can prime the youth brain for addiction.” Federal offi cials are scrambling to reverse a recent explo- sion in teen vaping that public health offi cials fear could undermine decades of declines in tobacco use. An estimated 3.6 million U.S. teens are now using e-cigarettes, represent- ing 1 in 5 high school students and 1 in 20 middle schoolers, according to the latest federal fi gures. Separate survey results released Monday showed twice as many high school students used e-cigarettes this year com- pared to last year.
