The election shall be conducted by mail pursuant to Oregon Revised Statute (ORS) 254.465 and ORS 254.470. The following question will be submitted to the qualified votes thereof: CAPTION: Amends City’s taxes on sales of Marijuana products QUESTION: Shall the City amend its marijuana taxes to impose a three percent tax on the sale of recreational marijuana? SUMMARY: The Gearhart City Council imposed a ten percent tax recreational marijuana and a five percent tax on medical marijuana, prior to the legalization of recreational marijuana by Oregon voters. After those taxes were imposed, the legislature passed regulations re- lated to local taxation of marijuana. Under state law, a city council may adopt an ordinance referring the three percent tax or fee on the sale of recreational marijuana items in the city by a licensed marijuana retailer. Cities may not tax medical marijuana. If this measure is adopted, it would approve the Gearhart Ordi- nance imposing a three percent tax on the sale of recreational marijuana items in the city by a licensed marijuana retailer. The tax would be collected at the point of sale and remitted by the mar- ijuana retailer. The measure also includes provisions regarding collection, administration and enforcement of the tax.
