NOTICE OF MEASURE ELECTION
CITY OF GEARHART
CLATSOP COUNTY, OREGON
NOTICE IS HEREBY GIVEN that on Tuesday November 6, 2018,
an election will be held within the boundaries of the City of Gear-
hart, Oregon. The election shall be conducted by mail pursuant to
Oregon Revised Statute (ORS) 254.465 and ORS 254.470. The
following question will be submitted to the qualified votes thereof:
CAPTION:
Amends City’s taxes on sales of Marijuana products
QUESTION:
Shall the City amend its marijuana taxes to impose a three percent
tax on the sale of recreational marijuana?
SUMMARY:
The Gearhart City Council imposed a ten percent tax recreational
marijuana and a five percent tax on medical marijuana, prior to
the legalization of recreational marijuana by Oregon voters. After
those taxes were imposed, the legislature passed regulations re-
lated to local taxation of marijuana. Under state law, a city council
may adopt an ordinance referring the three percent tax or fee on
the sale of recreational marijuana items in the city by a licensed
marijuana retailer. Cities may not tax medical marijuana.
If this measure is adopted, it would approve the Gearhart Ordi-
nance imposing a three percent tax on the sale of recreational
marijuana items in the city by a licensed marijuana retailer. The
tax would be collected at the point of sale and remitted by the mar-
ijuana retailer. The measure also includes provisions regarding
collection, administration and enforcement of the tax.
Notice is hereby given that a ballot title for a measure referred by
the City will be filed with the Clatsop County Elections office no
later than September 6, 2018. The ballot title caption is AMENDS
CITY’S TAXES ON SALES OF MARIJUANA PRODUCTS. Pursu-
ant to ORS 250.296(1) an elector may file a petition for review of
this ballot title in the Clatsop County Circuit Court no later than
5:00 p.m., August 15, 2018 (seven days after filing of this notice
with the Elections Officer).
The ballot title was filed in the Office of the City Recorder on Au-
gust 8, 2018, and a copy of the ballot title and the City Council
Resolution may be obtained by contacting the City Recorder at
Gearhart City Hall.
The following authorized City official hereby certified the above
ballot title is true and complete.
This Notice of Measure Election is to be published by the City
Recorder in a newspaper of general circulation to the city, in
the next available edition of such newspaper, after this Notice
of Measure Election is filed with the Elections Officer.
