The Durango then collided with the police car and was able to speed off. Minutes later, police came upon the accident scene — lit- tered with shattered glass from the damaged bus stop and blood from the two victims — outside of McDonald’s restau- rant after 9 p.m. They detained Barnett as she was allegedly walking away from the crash. A n investigation revealed the driver of the Durango, described as a female by wit- nesses, was driving northbound on U.S. Highway 101. The driver then led the SUV onto the sidewalk, struck a concrete light pole and slammed into a bus stop shelter occupied by the two men. Barnett admitted to being the driver and drinking prior to the crash, according to an affi davit. Circuit Court Judge Paula Brownhill has set Barnett’s bail at $500,000. She is sched- uled to appear in court again next week. If convicted on all charges, she faces a minimum of 16 years in prison. Barnett’s father is former Seaside Police Lt. Steve Bar- nett, who unsuccessfully ran for county sheriff in 2012 and retired last year. Barnett, a vet- eran police offi cer, had fi led a federal lawsuit against District Attorney Josh Marquis claim- ing his free speech and due process rights were violated when Marquis refused to use Barnett as a witness in prose- cutions because of concerns about the offi cer’s credibility. A federal appeals court ruled last year that Marquis had absolute immunity from the lawsuit. After enjoying the perfor- mance, the Stutzneggers made the brief walk back and stood outside their hotel just after 10 p.m. Suddenly, they heard three pops that, as many wit- nesses have said, sounded like fi reworks. Seconds later they heard a barrage of rapid fi re that lasted 15 seconds. No lon- ger believing fi reworks to be the cause of the noise, they rushed inside to their hotel room. ‘Scared’ At that point, all they could do was listen to the scanner, the endless emergency sirens blaring below, multiple heli- copters soaring above and the relentless rifl e fi re. “I was scared even though I was locked in my building,” Stutznegger said. “I wanted to get out of there.” He continued listening to the radio for about 1 1/2 hours. He tuned in as a SWAT team made its way to the hotel room where the shooter was located. ‘I don’t know that I’ll ever want to go there again.’ Norm Stutznegger Astorian who was in Las Vegas at the time of the mass shooting Stutznegger then heard a bang similar to a host of gun- shots or a door being kicked in. The shooter — Stephen Pad- dock, 64, of Mesquite, Nevada — repeatedly fi red through the hotel room door before police eventually entered the room and found him dead. With the sounds still fresh in their minds, the couple managed to drift off to sleep at roughly 3 a.m, a few hours after the bullets stopped fl y- ing. The original plan was to leave the hotel at 7:15 a.m., grab a cab and catch their fl ight home. But the strip was still locked down by the time they awoke. “The whole Las Vegas Strip was dead,” Stutznegger said. “It was weird.” For the fi rst time since rac- ing inside, the Stutzneggers ventured out to the street. As they once again stood outside their hotel and pondered a way out, the couple noticed con- cert goers who were still wan- dering around . “The looks on their faces was absolute horror,” Stutzneg- ger said. “They looked like zombies.” One woman they encoun- tered was still unable to remove the blood from her clothes and skin. A man asked them, in a scared and somber tone, if he could be the fi rst to take a taxi . His wife had been shot twice in the legs right next to him and taken to a hospital. She was about to go into surgery. “To be honest, I think he just needed someone to talk to real quick,” Stutznegger said. They gazed upon the empty area that had welcomed coun- try music fans just hours ear- lier. Quality of life The November vote is the latest step in the conver- sation started in 2013 when members of the Planning Commission and City Coun- cil considered changes to the way short-term rental proper- ties are taxed and regulated within the city. At the time, Gearhart had no ordinance requiring inspections or occupancy limits for vacation rentals . Fourteen property owners fi led an appeal with the state after adoption of regulations last fall. The state Land Use Board of Appeals upheld the city’s short-term rental rules in June.
