He points to the current sta- bility of the county due to a bal- anced budget and new county manager and human resources director. He also notes major projects such as the new crisis respite center for the mentally ill is moving forward. “I’m very happy with where things are at the county,” he said. Another motivation for him to move on is to spend more time in his Brownsmead com- munity. He lives there with his family and owns and operates a dairy farm. Sullivan has served on the Astoria Budget Committee and on the Astoria Visual Arts Board. In addition, she spear- headed the rebuilding of the Pioneer Shelter at Camp Kiwanilong in a leadership training project for the Ford Family Foundation. She is a sister of Iris Sulli- van Daire, a founder of Blue Scorcher Bakery. Astoria Station, a former auto dealership, stretches from Duane to Exchange streets, with a large parking lot front- ing 13th Street. The brewery would be located in the main showroom of the indoor gar- den supply next to Exchange Street, with the taproom in the former bicycle repair shop nearer to Duane Street. Williams is looking to place more food carts in the parking lot, which has played host to several over the years. Appeals court upholds limit on sharing of tips Longview ends By SUDHIN THANAWALA Associated Press SAN FRANCISCO — Businesses cannot collect tips given to waiters, casino deal- ers or other service employ- ees to share with support staff such as dishwashers even if the tipped employees are receiv- ing minimum wage, a federal appeals court has ruled. The 2-1 decision by the 9th U.S. Circuit Court of Appeals upheld a 2011 U.S. Labor Department rule. The 9th Circuit said Tues- day that the rule was reason- able and consistent with Con- gress’s goal of ensuring tips stay with employees who receive them. The court overturned district courts in Nevada and Oregon. The 9th Circuit ruling would largely apply to states that require workers to get the state minimum wage on top of any tips. Seven states fall into that category, according to the labor department’s Wage and Hour Division: Alaska, California, Minnesota, Montana, Nevada, Oregon and Washington. It was not immediately clear what the impact would be on back-end workers in those states. The 9th Circuit consid- ered two lawsuits in its rul- ing — one brought on behalf of plaintiffs including restau- rant and lodging associations in Washington, Oregon and Alaska and the other by two casino dealers against Wynn Las Vegas. The casino dealers said Wynn was taking their tips to share with other employees. The restaurant and lodging associations said the federal rule would prevent back-end staff from sharing in tips. Paul DeCamp, an attorney for the restaurant and lodging associations, said there was a decent chance one of the plain- tiffs would appeal. The company proposed two projects on land adjacent to the port but needs to use port prop- erty for its activities.
