Rohne: ‘I’m very happy with where things are at the county’

Looking at his service
with the county, Rohne said,
he feels comfortable stepping
way.
He points to the current sta-
bility of the county due to a bal-
anced budget and new county
manager and human resources
director. He also notes major
projects such as the new crisis
respite center for the mentally
ill is moving forward.
“I’m very happy with where
things are at the county,” he
said.
Another motivation for him
to move on is to spend more
time in his Brownsmead com-
munity. He lives there with his
family and owns and operates
a dairy farm.
He does not have any spe-

other community service
opportunities.
“I would like to be involved
in the community and would
welcome an opportunity to do
so,” he said. “Those possibili-
ties will only be open for me
if I move on and allow some-
one else the opportunity to
represent.”
On Tuesday, Kathleen Sul-
livan, who works at the front
desk of the Cannery Pier
Hotel, announced her intention
to run for Rohne’s vacated seat
in the May 17 election.
Sullivan has served on the
Astoria Budget Committee
and on the Astoria Visual Arts
Board.
In addition, she spear-
headed the rebuilding of the
Pioneer Shelter at Camp
Kiwanilong in a leadership
training project for the Ford
Family Foundation.
She is a sister of Iris Sulli-
van Daire, a founder of Blue
Scorcher Bakery.

auto dealership, stretches from
Duane to Exchange streets,
with a large parking lot front-
ing 13th Street. The brewery
would be located in the main
showroom of the indoor gar-
den supply next to Exchange
Street, with the taproom in
the former bicycle repair shop
nearer to Duane Street.
Williams is looking to place
more food carts in the parking
lot, which has played host to
several over the years.
Allison said he wants the
Thursday River People Farm-
ers Market held in the parking
lot starting in June to return.
Although Reach Break will
start small, Allison said the
brewery hopes to steadily grow,
potentially looking at an off-site
pub or distribution center three

Williams said he plans
to refurbish the Astoria Sta-
tion, including a new exte-
rior scheme and full-view
glass doors. He is also look-
ing into signage for the wall
of the Norblad Building back-
ing Astoria Station, and pos-
sibly video projections, as he
looks to make Astoria Station
a downtown destination.

Appeals court upholds limit on sharing of tips Longview ends

SAN FRANCISCO —
Businesses cannot collect tips
given to waiters, casino deal-
ers or other service employ-
ees to share with support staff
such as dishwashers even if the
tipped employees are receiv-
ing minimum wage, a federal
appeals court has ruled.
The 2-1 decision by the 9th
U.S. Circuit Court of Appeals
upheld a 2011 U.S. Labor
Department rule.
The 9th Circuit said Tues-
day that the rule was reason-
able and consistent with Con-
gress’s goal of ensuring tips
stay with employees who
receive them.
The court overturned district
courts in Nevada and Oregon.
The 9th Circuit ruling would
largely apply to states that
require workers to get the state
minimum wage on top of any
tips. Seven states fall into that
category, according to the labor
department’s Wage and Hour
Division: Alaska, California,
Minnesota, Montana, Nevada,
Oregon and Washington.
It was not immediately
clear what the impact would be
on back-end workers in those
states.

their hourly minimum wage
requirements from distributing
those tips to employees who
don’t regularly receive tips.
“The premise is the tip is
never the employer’s,” said
Reuel Schiller, a labor law pro-
fessor at the University of Cal-
ifornia, Hastings in San Fran-
cisco. “The employer doesn’t
have the power to take that
from the waiter and give it to a
dishwasher because it’s not the
employer’s money.”
Supporters of the rule would
say the employer should pay
the dishwasher higher wages
or charge customers to pay the
dishwasher instead of having
other staff subsidize the dish-
washer’s pay, Schiller said.
The 9th Circuit consid-
ered two lawsuits in its rul-
ing — one brought on behalf
of plaintiffs including restau-
rant and lodging associations
in Washington, Oregon and
Alaska and the other by two
casino dealers against Wynn
Las Vegas.
The casino dealers said
Wynn was taking their tips to
share with other employees.
The restaurant and lodging
associations said the federal
rule would prevent back-end
staff from sharing in tips.
Paul DeCamp, an attorney
for the restaurant and lodging
associations, said there was a
decent chance one of the plain-
tiffs would appeal.

sioners have cut off talks with
the Texas-based developer

talks with Waterside Energy.
The company proposed two
projects on land adjacent to the
