Mayor Don Larson was the lone supporter of the reTuest . Other councilors said they sympathized with 3oole, as the mistaNe was not his, but did not support JivinJ away property that could be used in the future to meet public needs. Do- inJ so, they said, could set a danJerous precedent. ,n 1, 3oole¶s par- ents, %ob and Marianne, developed their property on 1orth +olladay Drive near 6easide +iJh 6chool and added a pool that crossed property lines onto what used to be 21st Avenue. 3oole is tryinJ to correct the mistaNe to enable sale of the property. &onsultinJ firm OtaN ,nc. recommend- ed he seeN a street vacation, which would reTuire the city to enact an ordinance. ³:e¶re Must tryinJ to solve the problem,´ 3oole said. ³:hat was suJJested to us was the vacation, be- cause this was the Jeneral theory, that streets are dedi- cated to the public. They¶re donated, and if they¶re not needed they Jo bacN to the adMoininJ landowners.´ Larson favored JrantinJ the reTuest, sayinJ the city has passed ordinances re- linTuishinJ public riJht-of- way to adMacent landowners in the past. Montero said records show the city did so be- tween 20 to 30 times in the past but has not vacated a street since 200. 6he said she does not feel comfort- able JivinJ up public prop- erty. &ity attorney Dan 9an Thiel said he does not ad- vise cities to vacate streets unless they are certain the property will never be needed for public use, ³an e[tremely hiJh bar´ to meet, he added. Larson said he does not thinN the property, about 50 sTuare feet, means ³anythinJ to anyone.´ ³Tita, , don¶t believe that most of the people that voted for you, any of them, Nnow about this street,´ Larson said. ³This is Must not a Nnown item. This is only Nnown by the people here and the people in the audience.´ &ouncilor 6eth Morrisey said he was in favor of a licensinJ aJreement rath- er than a street vacation. A licensinJ aJreement would allow the property owners to leJally occupy the city riJht-of-way, but the city could reclaim the property for future use. +owever, a licensinJ aJreement is tem- porary, which could maNe it difficult for prospective buyers to secure financinJ.
