Justice is now lame and blind anions: us: the jury in the Martin trial after many hours of deliberation have so stated in their verdict. The storv of the labors of the jury is in teresting and reads as a dream. A verdict of manslaughter, and Martin stands acousen of the murder of Nathan Wolf, the Portland jeweler. Tuesday he was sentenced to fifteen years and a fine of one thousand dollars. Jus ' tice did not soften the hard rigors ot the law nor blunt its keen edge, but in the mill of ignorance was ground its harpy claws. Sin was supposed to be discovered, yet could not be re moved, nor if so found was it pun ished. On the first ballot the jury dis cussed the simple question of guilt or innocence, without regard to the de gree of guilt; eight stood for convio tion and four for acquittal. Two of those who gave ballots for conviction were really inclined to the defense, and they votod that way most of the time afterward. It also developed that some of those voting for convic tion were in favor of the second de gree. Then the confliot between the op posing forces settled down to a drawn battle. So many ballots were taken that the jurors lost count. Thoy esti mate the numbor at 40. Between these ballots there was time for argu ment and analysis of the testimony, but this apparently had littlo effect, for the voting was substantially the same. Thus it continued through the nitfht, with only a little more than an hour of sloop. Early in tho morning the 2 voting was resumed, and it seemed that a doadlock mast result. Some of the jurors were ready to quit, and wanted to report that thoy could not agree. But others clung to a hope for a verdict, and agreed ' that they owed it to the state to save the expense of another trial if possible. The suggestion was made a verdict of manslaughter. It did not meet in stant favor, but several of the better debaters took it np and tiie balloting became mixed. yihe compromise spirit had started on its course, and although some of the more determined onos were reluctant to change, they were overpowered by the argumonts of the minority. "We saw that it had to be a hung jury or manslaughter, " said one of the jurors who votod for acquittal, "aud we thought the people would approve the giving of the verdict, thus avoiding another long drawn tial. "We were six and six nearly all the way through, and we who voted for acquittal were not willing to go too strong on oiuumstautlal evidenoe. There were too many chances for a mistake, aud if you take the life of a mau you cau't restore it. But a tonn in prison may make a now man of Martin and put him on his feet again when he gets out. So iu the end it was unanimous for manslaughter, and I oan toll you my conscience is clear. Some said we would be oritioisod, but I say let them oritioise. I think we did the right thing." "And I have no faith in Martin quit ing the use of drugs. He will be at it again as soon as lie has a chance. But I agreed with thoso who thought that we ought to find a verdict, and not disagree. Thore have been several courts martial in the army recently for drumtonness. A great many people want it who can not nOord to have it. There ore prob ably as many people unhappily mar ried in tho alley as on Fifth Avenue and there are as many people who would like to bo rid of each other in Oshkosh as in Newport except that when tho people in Newport find themselves unhappy they take legal means to got rid of their unliappiness boeauso thoy oau afford the alimony. This, it is stated, is true iu Maryland, Missouri, Illinois, Indi ana and Arkansas, while Massachu setts will harvest loss than a 60 per cent crop. Connecticut, New Hamp shire, lihode Islaud and Vermont re port as much fruit as in 1U07, but tho crop in Maine will be smaller than it was last year. However, the quality is fair in most of the districts. Roports from Ohio give estimates ranging from 20 per cent of a full crop to 75 per cent, it being added that in most parts of the state .the yield is better than in 1U07, though the crop of win ter apples is light. The northwestern nnd Pacific states report crops of quality and quantity. California heads the list with a nor mal yield, while Colorado. Oregon and Idaho have yiolds ranging from 05 to 85 per cent in the order named. Utah also has a good yield with larger acreage than in previous years. Growers in Washington report that in most districts, notably the Yakima, Wonatchee, Prosser, Spokane and Okanogan valleys, the yield will be about 85 por cent, with a larger acreage than ever before in the his tory of the state. Growers in the Pacific stateB prob ably will receive hotter prices for thoir product than in former yours, for the reason that the buyers' pool has been broken and it is predicted that beiore the close or JNoveuiuur or early in December there will be general scramble of representatives of commission houses to load up on the apples not already sold.
