JUSTICE LAME.
Justice is now lame and blind
anions: us: the jury in the Martin
trial after many hours of deliberation
have so stated in their verdict. The
storv of the labors of the jury is in
teresting and reads as a dream. A
verdict of manslaughter, and Martin
stands acousen of the murder of Nathan
Wolf, the Portland jeweler. Tuesday
he was sentenced to fifteen years and
a fine of one thousand dollars. Jus
' tice did not soften the hard rigors ot
the law nor blunt its keen edge, but
in the mill of ignorance was ground
its harpy claws. Sin was supposed to
be discovered, yet could not be re
moved, nor if so found was it pun
ished. On the first ballot the jury dis
cussed the simple question of guilt or
innocence, without regard to the de
gree of guilt; eight stood for convio
tion and four for acquittal. Two of
those who gave ballots for conviction
were really inclined to the defense,
and they votod that way most of the
time afterward. It also developed
that some of those voting for convic
tion were in favor of the second de
gree. Then the confliot between the op
posing forces settled down to a drawn
battle. So many ballots were taken
that the jurors lost count. Thoy esti
mate the numbor at 40. Between
these ballots there was time for argu
ment and analysis of the testimony,
but this apparently had littlo effect,
for the voting was substantially the
same. Thus it continued through the
nitfht, with only a little more than an
hour of sloop. Early in tho morning
the 2 voting was resumed, and it
seemed that a doadlock mast result.
Some of the jurors were ready to quit,
and wanted to report that thoy could
not agree. But others clung to a
hope for a verdict, and agreed ' that
they owed it to the state to save the
expense of another trial if possible.
The suggestion was made a verdict of
manslaughter. It did not meet in
stant favor, but several of the better
debaters took it np and tiie balloting
became mixed. yihe compromise
spirit had started on its course, and
although some of the more determined
onos were reluctant to change, they
were overpowered by the argumonts
of the minority.
"We saw that it had to be a hung
jury or manslaughter, " said one of
the jurors who votod for acquittal,
"aud we thought the people would
approve the giving of the verdict,
thus avoiding another long drawn
tial.
"We were six and six nearly all the
way through, and we who voted for
acquittal were not willing to go too
strong on oiuumstautlal evidenoe.
There were too many chances for a
mistake, aud if you take the life of a
mau you cau't restore it. But a tonn
in prison may make a now man of
Martin and put him on his feet again
when he gets out. So iu the end it
was unanimous for manslaughter, and
I oan toll you my conscience is clear.
Some said we would be oritioisod, but
I say let them oritioise. I think we
did the right thing."
"A fellow that goes aud fires a shot
at another's head and trios to kill
him has mulice in his heart, and that
is the way I felt about this case,"
said another juror whoBe views were
opposito to the mau abovo quoted.
"And I have no faith in Martin quit
ing the use of drugs. He will be at it
again as soon as lie has a chance.
But I agreed with thoso who thought
that we ought to find a verdict, and
not disagree. Tho verdiut will put
him where he cm do no harm, and
he may take the lesson to heart. ' '

Israel Zangwill has changed a line

President has asked that the words
"the four hundred" be substituted
for " Americans. " The change was
made on the plea of charity tor onr

contain a venomous sting. The joke
at best is a poor and much over
worked one and in his role as censor
tho President might have advised its
elimination as unworthy of a great

does have more divorces in proportion

something like an automobile. A

Dear Sir: I have been thinking of
writing to you for some time to let you
know what Peruna did for me.
I am 67 years old. il lost my health
about six or seven years ago. I first
had dyspepsia and employed different
doctors.
Last yearl injured oneof my kidneys.
I had one ot the best doctors for that.
He put me to bed, not to move for two
weeks,
I slowly recovered, but was so weak
and prostrated that I could walk but a
short distance. In fact I had to keep
quiet.
I took several remedies, but obtained
no relief, lalso had catarrh in some
form.
My wife advised me to take Peruna,
and It Is with pleasure that I can say
that by taking one and one-half bottle
of vourPeruna.lt cured me and I feel
all right. I send this wHh many thanks
to you, as I enjoy life again.
My wife has also been taking your
Peruna for asthma and it helps to re
lieve her. We keep your Peruna in
the house constantly. Again I say I
thank you for Peruna.
Sincerely yours,
PHILIP KRATZ.
Fonntatnvllle, Pa., Not. 9, 1903.
Dr. B. B. Hartmau.
Dear Sir: I have good health now and
your valuable medicine gave me good
health. I have had no doctor for some j
time, as I do not need any. When 1
take cold I take Pernna and in a short
time I am all right. My wife is subject
to asthma. She takes Peruua.at that
time, and she has had no need for a doc
tor for some time. With many thanks
for your medicine, we remain,
Sincerely yours,
PHILIP KRATZ.
' Fonntainville, Pa., April 16, 1908,
Dr. S. B. Hartmun.
Dear Sir: We have Peruna in the
house all the time and when we think
we need it, we take it. We are about
sixty years old and have not called a
doctor to our place for some years.
We go out in all kinds of weather and
sometimes wheu we go on a trip we
take Peruna along. A preventive is
better than a cure. That bus been our
experience.
I had poor health some years ago and
when I found your medioine 1 hit the
right thing. We both thank you for
your good medicine.
Sincerely yours,
PHILIP KRATZ.

spraying -t the proper time. The
crop in New Jersey is fair. Roports
from Ohio give estimates ranging
from 20 per cent of a full crop to 75
per cent, it being added that in most
parts of the state .the yield is better
than in 1U07, though the crop of win
ter apples is light.
The northwestern nnd Pacific states
report crops of quality and quantity.
California heads the list with a nor
mal yield, while Colorado. Oregon
and Idaho have yiolds ranging from
05 to 85 per cent in the order named.
Utah also has a good yield with
larger acreage than in previous years.
Growers in Washington report that in
most districts, notably the Yakima,
Wonatchee, Prosser, Spokane and
Okanogan valleys, the yield will be
about 85 por cent, with a larger
acreage than ever before in the his
tory of the state.
Growers in the Pacific stateB prob
ably will receive hotter prices for
thoir product than in former yours,
for the reason that the buyers' pool
has been broken and it is predicted
that beiore the close or JNoveuiuur or
early in December there will be
general scramble of representatives of
commission houses to load up on the
apples not already sold. In this con

several orchardists in tho central part
of Washington have turned to the
Australian and London trade, where
their applos bring the top market

What To Do.
There is comfort in the knowledge so
often expressed, that Dr. Kilmer's
Swamp-Root, the great kidney remedy,
fulfills every wish in curing rheumatism,
pain in the back, kidneys', liver, bladder
and every part of the urinary passage.
It corrects inability to hold water
and scalding pain iu passing it, or bad
effects following use of liquor, wine or
beer, and overcomes that unpleasant ne
cessity of being compelled to go often
during the day, and to get up many
times during tiie night. The mild and
the extraordinary effect of Swamp-Root
is soou realized. It stands the highest
for its wonderful cures of the most dis

Why Colds Are Dangerous.
Because you have contracted ordi
nary colds and recovered from them
without treatment of any kind, do not
for a moment imagine that colds are
not dangerous. Everyone knows that
pneumonia and chonic catarrh have
their origin in a common cold. Con
sumption is not caused by a cold but
the cold prepares the system for the
reception and development of the
germs that would not otherwise have
found lodgment. It Is the same with
all infectious diseases. Diptheria,
scarlet fever, measles and whooping
cough are much more likely to be
contracted when the child has a cold.
You will see from this that more real
danger lurks in a cold than in any
other of the common ailments. The
easiest and quickest way to cure a
cold Is to take Chamberlain's Cough
remedy. The many remarkalile cures
effected by this preparation have
made it a staple article of trade over
a large part of the world. For sale
by Huntley Bros. Co., Oregon City and
