Delores Pigsley will be present on Saturday. Jessie Davis was unable to attend the morning session. TRIBAL COUNCIL PRESENT: Pat Morrell, Tribal Vice-Chairman Clifford Case Denise Peterson Reggie Butler Geneva Johnson Jessie Davis (1:00 p.m.) There was a request to discuss the Commission appointments. Burgess requested time in Ex ecutive Session. Park Nelson requested time on the agenda. Pat added Tribal Council concerns on Saturday. MOTION # 1 - JoAnn Miller moved to approve the agenda as amended. Seconded by Clifford Case. Motion approved 6-0-0. TRIBAL COUNCIL ABSENT: COPS PROGRAM - Brenda Bremner Lillie Butler Delores Pigsley(Present Saturday 9:00 a.m.) On April 7, 1997, the Law Enforcement Ad-Hoc Committee met and identified several viable op tions. The Tribe has 3 years to have matching funds for the COPS Grant that has been awarded. Nelsen stated there may be program money available to help with this issue. The Tribe must identify these funds. Our match would be required in 1998 and 1999. All options require the Tribal Council to formally establish/commit funds specified for law enforcement to be used for start-up planning, matching funds or the COPS grant, and additional funds to augment the COPS dollars for support staff, equipment, etc. Nelsen reviewed the reasons Why we have had difficulties estab lished law enforcement using the County. Brenda reviewed the options available. Roll Call was taken with 6 present and 3 absent. Lillie Butler and Delores Pigsley were not y i Option #1 -Establish (one member) Tribal Police Department. Position could be established as an Interim Director of Public Safety and Emergency Services. This position could develop a plan to respond to the COPS Grant objectives, develop the Operations and Procedures Manual for the Police Department. The Tribe could use IPA from the BIA at Captain level for 2-4 years. This would require working with the County. The cost would be approximately $30,000 to $50,000 for startup. There would be additional costs with matching funds which would include equipment, travel and misc. Down the road, the Tribe would want to include trust lands like Chinook Winds. Initially they would like to meet the goals and objectives of just the grant. Currently there is a concern regarding response time with the local law enforcement. Reggie asked, because we do not have a jail, what would we do with people we arrest. Nelsen said we would be cross depu tized, they would go over to the County Jail. This would be a state issue. Most of our ordinances would be citations and would be served with notice to appear in Court. A concerning issue was if we have specific tribal laws, that are not state laws that would require special attention. We need to be concerned with the impact on our Tribal Courts. If Interim Director was used, because of an JPA, this position could only be up to 4 years. Option #2-This would be an expansion of #1, but would include 3-5 officers, including dispatch services. This would be an ideal department, but requires a fast track. The estimated time frame of 4-6 months would be necessary for establishment of a full staffed department. The cost would be approximately $350,000 to $450,000 for minimal staffing and support costs. Denise asked if they looked at other police departments in other Tribes. Brenda said they had visited the Warm Springs force. Denise said they need to look for a planning grant to find funding first. Denise stated we really need more than one officer to be effective. The COPS Grant could be used for leverage. JoAnn said we need to commit to having law enforcement and the insurance would be federal for insurance coverage for the law enforcement. Nelsen said if we have our own police department, we could do our own back ground investigations. We would be linked with the FBI and such. Nelsen said there are certain issues that will need to be addressed regarding public law
