Clarification Of Compulsory School Attendance Law T h e question c o n sta n tly com es u p on th e p art of em ployers, "Can I h ire a high school stu d e n t for a few days w ork, or p a rt-tim e w o rk d u rin g school h o u r s ? ” A le tte r ju s t received from W E. K im sey, s ta te com m issioner of labor, an sw ers the question in th is m a n n e r: ‘‘No m inor u n d er 18 y ea rs of ag e can be leg ally em ployed u n til th e em p lo y er has in his pcss ssion a w ork perm it from the office of the labor com m issioner. “This office h as v o lu nteered in th e en fo rcem en t of th e com p u lsory a tte n d a n c e law by re o u irin g em ployers of m inors u n d er 18 y ea rs of age, to pro vide this office w ith a release from school a tte n d a n c e .” In o th e r w ords th e stu d e n t c a n not legally w ork w ith o u t a w ork perm it, and he cannot get a w ork perm it w th o u t a release from school a tten d a n ce. I he stu d e n t can no longer profit from a tte n d a n c e at school. 3. A tten d an ce at school would ca u se an e x tre m e hardship on the family. U nder th e last tw o c irc u m stances, th e p aren t of the m inor would ask the school board for a release for th e ir child, and if g ra n te d by the board, a release would be sent to th e labor com m ission. E x tre m e h ard sh ip m eans of course, th at the stu d e n t m ust con trib u te to a g re at e x ten t tow ards the sup p o rt of the fam ily. It is to be fu rth e r noted th at the above conditions assum e th at the stu d en t who secures a release irops out of school, secures his w ork perm it, and then s ta rts w orking. T herefore, unless the stu d en t has dropped out of school it is fairly safe to assum e th at he has not been excused from school, and dot's not have a w ork perm it, and th at as an em ployer, you cannot legally hire him. It is to be fu rth e r n o te d l h a t if ihe s tu d e n t is hired for out o ' school hours, he still is req u ired o o b tain a w ork perm it. E m ployers should be careful to check he perm it, and see th at it calls o r lull tim e w ork if the stu d en t s v. oi king during school hours.
