JONES Poat C«respondent A court order signed earlier this month will pre vent further attempts by the M t Hood N a tu ral Resources Coalition to op pose a hydroelectric facili ty on Minikahda Creek in the Zigzag area The order concerns itself with the construction of a m ic r o h y d r o e le c tr ic generating plant, proposed by P a u l S an d ers of Portland and Zigzag, near the junction of Barlow T rail Road and Lolo Pass The Minikahda project was opposed by the coali tion at a hearing before the Clackamas County Com mission on Feb. 11, when S a n d e rs a p p e a le d an earlier denial of his propos ed hydro by a hearings of ficer The hearings officer rul ed that the project was pro hibited by the existing zon ing and development or dinance since it was to be constructed on land in ex cess of 35 percent slope Sanders argued through his a tto r n e y , F ra n k Josselson of Portland, that slopes are essential in the generation of power from hydro facilities and that the ordinance was w ritten w ith o u t the in te n t of restricting such projects The c o a litio n , represented by attorney E d w a rd S u lliv a n of Portland, requested that the commissioners refuse the a p p lic a n t’s appeal since it was in violation of an existing ordinance T he c o m m is s io n e rs , perhaps fearing a lawsuit, voted to deny the condi tional use permit at the time and directed the plan ning staff to d raft an am endm ent to the o r dinance in order to a c comodate hydro facilities on such slopes Sullivan also said that siting requirements for h y d ro e le c tric p ro je c ts should be established in the county to prevent future problems concerning the location of such facilities Josselson agreed and a joint citizens committee, comprised of individuals re p re s e n tin g both en vironmental and develop ment concerns ( including both attorneys), met and drafted a set of proposed requirements for locating hydros in the county On April 12 the slope amendment was approved by the commissioners and a special use perm it for S an d ers* p r o je c t was Issued The Minikahda Creek project was approved bas ed on two sets of conditions the project is required to meet The first set relates to ten conditions set forth in the planning staff's Oct. 1 recommendation for the project’s approval These conditions include limiting site excavation to the mon ths of Ju n e th ro u g h September, the protection of a domestic water system located below the project, reseeding exposed soli, and conducting a geological engineering study to iden tify any instability in the project area, The second set of condi tions Sanders will have to meet is set forth in the April 7 discussion draft of the proposed hydroelectric fa c ility ordinance The draft contains four pages of requirements In locating hydro facilities In exchange the coalition members, including Larry Henderson, a Minikahda Creek property owner, Carol Smith of the En vironmental Committee On Suitability, ex M t Hood re s id e n t Peg K a s p e r, naturalist Arch Dtaek, and members of the Rhodeden dr on Neighborhood Group, can no longer oppose the project Sullivan said that esaen (ta lly the court order m e an s th e c o a litio n will not use the gf t v f i in I to iippBS» this particular DON’T MISS IT! • Hoodland Happenings • SALE! banana SPLIT 9F The Oregon Trail Shopping Center’s . . . r I I D a iry fliip p n COUPO ¡ BONANZA!
