RESOURCES OF THE STATE OF OREGON Order for Public Hearing • In the Matter of the Formotion of a County Service D istrict in Clackomas County Oregon due to o Donger to Public Health in on Area Coinciding with the Boundaries of the Service Ter ritory Allocoted by the Public Utility Commissioner for Opera tion of the Alder Creek Barlow Riverside Sleepy Hollow Mt Hood Country Club and Wildwood Annex W ater Systems pur Suant to the Provision» of ORS 431 705 to 431 760 The State Health Division previously received a certified copy of an Order and Resolution of the Clackamas County Board of Commissioners acting os the Clockomos County Board of Health dated January 8 1981 e«pressing the Board s belief that a donger to public heulth exists in the above captioned areo and requesting the Stote Health Division to in vestigate the condition» and to initiate proceedings for the for motion of a new county servic district without vote or consent in the affected area pursuant to ORS 431 705 to 431 760 Copies of such Order and Resolution ore attoched hereto m arked Exhibit A and 8 respectively and are by this reference incorporated herein and made o part hereof The Board has also caused preliminary plans specifications ondo time schedule to be subrmted to the Division relative to the service facilities considered necessary for removal or allevio tion of the alleged conditions causing a danger to public health The Division has reviewed and investigated the conditions in the subiect territory and has found substantial evidence that o donger to public heolth os defined in ORS 431 705 exists in eluding conditions of improper construction operation and management of the water systems serving the area ond of im pure and inadequate domestic wafer in the area The Division finds that a public hearing should be held before a hearings of ficer designated by the undersigned pursuant to the provi Sion» of ORS 431 705 to 431 760 183 310 to 183 500 and rules odopted thereunder IT IS THEREFORE ordered that a public heoring to be held before the designated hearings officer pursuant to the provi s.on» of ORS 431 705 to 431 760 183 310 to 183 500 and Oregon Administrative Rules Chapter 333 Section 333 12 001 and Sections 12 035 through 12 045 as omended effective August 19 1981 The hearing is to commence at the hour of 10 30 a rn on the 13th doy of October 1981 at the Wemme lio n s Club on Highway 26 in Wemme Oregon a place near the above captioned area The purpose of the hearing is to determine (1) Whether a danger to public health exists due to conditions in the s u b le t territory including improper con strucfion operation or m anagem ent of the water systems ser ving the area and impure or inodequote domestic water in the area ond (2) whether such conditions County Oregon RESOLUTION NO I Whereas investigations have been reported to his Board concerning the Alder Creek W oter Company and Whereas those investigations indicate inadequate service fa cilities resulting in im properly disinfected w ater microbiological contamination excessive turbidity and incon sistent and unreliable service and Whereas ORS 431 705 to 431 760 provides for formation of a county service district when the Board of Heolth believes thot conditions dangerous to the public health exist Now therefore Be it resolved that the Clackamos County Board of Health believes thot
