Public Notice Attention Property Owners inside the city limits of Cave Junction: Tis the season to ad- dress WEEDS.Weeds are a nuisance visu- ally but more impor- tantly they provide an excellent source of fuelfor fires. In the past the City has sent out written remind- ers to property own- ers to clean up their properties and meet code standards and to help avoid fires. Again this year, the city may send out reminders providing 10 short days to ad- dress the unsightly and dangerous issues of unattended weed growth, however… Beginning 2018, property owners will be required to meet code specifications on their properties with- out written reminders from the City. If property owners are delinquent in tak- ing care of their prop- erties they will be no- tified of the violation and cited for up to $500 per day that the violation continues. Municipal Codes can be searched and read on the city’s website: cavejunctionoregon. us Below is the code that we are referencing: Cave Junction Mu- nicipal Code 8.08.090 - Grass, shrubbery, weeds and noxious growth. A. No owner or person in charge of property shall permit weeds or other nox- ious vegetation to grow upon his prop- erty. It shall be the duty of an owner or person in charge of property to cut down or to destroy grass, shrubbery, brush, bushes, weeks or oth- er noxious vegetation from becoming un- sightly, from becom- ing a fire hazard, or in the case of weeds or other vegetation, from maturing or from going to seed. B. Except on prop- erty classified as “residential agricul- tural” under the zon- ing ordinance of the city, the existence of grass, brush, weeds, bushes or other nox- ious vegetation to a height of over twelve inches from the ground shall be prima facie evidence of a fire hazard. (Ord. 109 §19, 1974) 8.08.240 - Violation- Penalty. A. Any person vio- lating any of the pro- visions or failing to comply with any of the mandatory re- quirements of this chapter is guilty of a municipal offense. Any person convict- ed of an offense un- der this chapter shall be punished by a fine not to exceed five hundred dollars and shall pay the costs of the proceedings. B. Each such per- son is guilty of a sep- arate offense for each and every day during any portion of which any violation of any provision of the or- dinance of the city is committed, contin- ued or permitted by any such person, and he is punishable ac- cordingly. C. Any person vio- lating any of the pro- visions or failing to comply with any of the mandatory re- quirements of any ordinance of the city shall pay all reason- able attorney fees in- curred by the city for enforcement of the ordinances against said persons. D. The requirement to abate a nuisance is not a penalty for violating this chapter but is an additional remedy. The imposi- tion of a penalty does not relieve a person of the duty to abate the nuisance; how- ever, abatement by a person responsible of a nuisance within ten days of the date of notice to abate, or if a written protest has been filed, then abatement within ten days of the council’s determination that a nuisance exists, will excuse the person responsible for pros- ecution. (Ord. 109 §§49, 50, 1974) (Ord. No. 517, § 4, 10-14- 08) 6.21&28-B
