Now Gay365.com reports that the Campaign for Califor nia Families, a conservative Christian legal activist group, has announced a bid to uaseat McMaster on the grounds that his ruling implies marriage by another name. Reports are that the W hite House did not encourage him to stay. It will take effect with the confirmation of his successor. T he social conservative drew fire from the political left from the start. The Human Rights Cam paign was among those who vocally opposed his nom ina tion. As a senator from Missouri, he had garnered a zero rating from that organization. Log C abin Republicans closely followed the confirmation process and ended up not tak ing a public stance on the nom ination. Its executive director at the time, Rich Tafel, said: “T he key for us was what he kept saying during the hearings, T h is will not be John Ashcroft’s attorney generalship, this will be President Bush’s attorney general’ and reflect the adminis tration’s position.... T h e most im portant thing for us was that his statem ents were looking forward, not looking backward.” Eight Democrats joined all of the Republicans in the Senate in confirming Ashcroft 58-42. T he position of attorney gen eral traditionally is thought sus pect by civil libertarians. T h e p o st-9/11 passage of the U SA Patriot A ct, and A shcroft’s tactics in im plem enting it, provided ample fodder for such criticism from across a broad swath of the political spectrum. Ashcroft won grudging praise for his in d ictm ent of Darrell David Rice for the brutal murder of two lesbian hikers in Virginia’s S hen an d o ah N atio n al Park in 1996. T h e victim s, Julianne M. Williams, 24, and Laura S. “Lol- lie” W inans, 26, had met the pre vious year in M inneapolis and had established a household in Ver mont. They tfere on a five-day hackpacking trip through the Vir ginia m ountains when their naked kxlies were discovered hound and gagged, their throats slashed. He invoked a federal sentencing enhancem ent for victims of hate crimes that could bring the death penalty. It was the first time that provision had been used in a queer case. However, the indictm ent was withdrawn in February 2004 when some of the initial evi dence was found suspect. In June 2003, senior officials at the D epartm ent of Justice told DOJ Pride, an organization of queer employees, th at they could no longer hold planned Gay Pride activities at agency facilities. W hen news of the decision created a public stir, those officials backtracked, saying that the event could be held but th at the agency would not officially sponsor it and that DOJ Pride would have to pick up any costs associated with using the room. In M arch o f this year, Ashcroft was hospitalized for pancreatitis and had emergency surgery to remove his gallbladder. He was away from the office for about a m onth and has m aintained a lower profile since returning. W hite House counsel A lberto Gonzales has been nom inated to succeed Ashcroft.
