E. lhirton has made a care tut study of the matter, and an
nounces his findings. There are, lie says, three theories
concerning the treaty-making power:
"I. That a treaty negotiated by J 'resident, which re
ceives the advice and consent of the Xdutte by rote of
two-thirds of those present, is final and binding, and that
the action of the House is only formal.
"2. That the ( Vmgrcss, meaning the House especially,
lias the right in the case where an agreement is to bo
rxecuted, such as the scrapping of vessels, to witliMd lis
approval, . thus possessing a right 1o vr'lo a treaty which
requires the payment of money, modifies duties or in
cludes powers given by the Constitution to the Congress.
"M. That while a treaty may require action by the
J louse., a moral obligation rest upon that body to enact

Mr. Ihirton has come to the conclusion that "itVns
evidently the idea of the framcrs of the Constitution that
the treat v-niaking power nested in the president, and
sonatu shu uld be final and conclusive," but that this in
tent was notiruWy realized, because' of'conflict ing power:
conferred on the House. As matters stand, when if comes
1o a paclical application of the idea, he explains, many
times the authority of the House1 is necessary, because
the House, rather than the Senate, h,s the, power to make
appropriation's. If the treaty involves jnony-spendiug,
then, it cannot be carried out without the approval of the
louse, for "all bills for raising rcveiim- shall originate
in the House of Representatives."
Mr. IJurton's .opinion js not necessarily conclusive
The matter will doubtless -have to be decided sooner or
later by the Supreme Court. In the meantime, it is im
portant enough to justify considerable, discussion.
