W. EaRtman, after being first duly sworn upon my oath depose and say: ' That today September 12, 1917 at about 3 o'clock p. m. one O'Leary came to me as a client saying he was nrr.ested by Chief of Police Reyburn fci smoking a cigar (smoll cigar) I went over to the Police Station with Mr. O' Leary to ask the Chief of Police about it and could not find him,so we went together down the street to look for him. We met Mr. Reyburn in front of Hughe's Cigar Store and I politely asked hm what lie had arrested the boy for and he said for' smoking cigarettes. I then told him the boy said it was a cigar and that you (Mr. Reyburn) told the boy that it was all the same. told him that he had told Mr. Ware not to sell any more of those little cigar and he said he did not say ro but that he told him not to sell any more (CIGAR-ETTES), however what he meant I do not know. We .talked the matter over. I telling him that the boy had a right to smoke little cigars and then he got insulting and said he did not want to have any thing to do with me and in the pre i many witnesses, at least a dozen, and just as. I was turning to go he said: "You pin-head." I turned and told him he had not better call me a yin head on the stree and he re liueu in mese woras: xou are a PIN-HEAD AND WITHOUT VIS IBLE MEANS OF SUPPORT. I uicn told him I would have him charged with slander. He said all right. Mr, u Jii. M,oran was one of the wit nesses. There were many more and as this affidavit js addressed to the uty commissioners of La Grande Oregon, I shall get other witnesses' names. , I swear to this affidavit and hand ic to the Commissioners for the reason that I think no Police Officer has a right to nbuse a citzen in the peaceful occupation of asking him some questions.
