Press) With the organization and
other preliminaries completed at the
opening yesterday the Third Quad
rennial Meeting of the Federal Council
of Churches of Christ in America to
day settled down to the transaction
of business. The 450 delegates at
tending represent thirty of the leading
protestant denominations in the
United States with a total member
ship of more than eighteen millions.

sessions are William Jennings Bryan,
Professor Shailer Mathews, the Rev.
Charles S. McFarland, Dr. Frederick
Lynch, Gifford Pinchot, Raymond
Robins, Fred B. Smith, Dr. Charles L.

CHOCOLATE CAKE. Itcat tho yoU
of an egg, add half a cupful of
milk, a cupful of sugar and a
cupful of grated chocolate, cook over
boiling water until It thickens, then
set nsldo until cold. Cream half a cup
ful of butter, add gradually a cupful
of.uugnr. thou add half a cupful of
milk alternately with two and a half
cupfuls of (lour sifted with two round
ed teaspoonfuls of baking powder.
Flavor with two teaspoonfuls of vntiil
la, add the cold chocolate, mixture and
bake In layers. Boil two cupfuls of
sugar and half a cupful of water un
til It threads, then pour slowly on the
whites of two egss beaten very stiff,
add two squares of melted chocolate,
flavor with vanilla and spread be
tween the layers and over the top of
the cake.
Walnut Cream For Filling. A cup
ful and a half of milk, scalded, an egg
well beaten, a scant half cupful of
sugar, a dessertspoon f til eueb of flour
and cornstarch, a quarter ten spoon fill
of salt, mix nil with cg, ndd to milk
nud cook In double holler until quite
thick. Wheu cool lluvor With vanilla
and add a cupful of hickory nuts
ground fine (pass them through meat
chopper). .Spread on cuke. If you
prefer use n white frosting on (op and

Unlsiu Cake. This Is fine and keens

Take an egg, bent thoroughly, add a
tablcspoonful of hud. a tnlilcspooiiful
of butter and three-quarters of n cup
ful of sugar. Heat wi;ll. Take half a
cupful of tho water In 'which you have
boiled half a cupful of raisins; to this
water add a lenspoonful of Boda, a
cupful and a half of raisins and a
cupful mid a half of Dour. Hake In
moderate oven.
Nut Cake Cream three-quarters of
a cupful of butter with a cupful of
sugar and ndd two well beaten eggs
and a cupful of milk. Sift together
two cjpfuls of Hour, a tcaspoonfiil anil
a half of linking powder and a pinch
of salt. Stir into the milk, sugar and
eggs and then ndd n cupful of chopped
rnlsliis and a cupful of chopped nuts,
flake In shallow loaves. Ice with
white Icing and' add halved nuts for
decoration.
FRANCHISES'
RATES UPSET
Public Service Commission has Au
thority to Set Aside Rates Provided
in Any Oregon Franchise.
Salem, Or., Dec. 7. (Special) The
State Public Service commission has
power to make an order permitting a
telephone company to charge cus
tomers more than the rates named in
a franchise, tho supreme court held
this morning m a decision in the case
of the city of Woodburn against the
Public Service commission and the
Western Telephone company. In
other words the franchise of a city is
of no effect when the state wishes to
exercise its authority. The supreme
court holds that the right to regulate,
rates is essentially a police power.
After the consolidation of tho
United Telephone company, with the
Western Telephone company, the Pub
lic Service commission a year ago di
rected that the Western company
charge a specific schedule of rates and
it was contended " that these rates
were in excess of the ones named in
the franchise.
Company Was Enjoined.
Circuit Judge Galloway of Marion
county, enjoined the company from
exacting any charges in excess of the
amounts specified in the charter, and
the supreme court reversed his de
cision. "The inquiry involves two general
questions, first, the effect of the
franchise when considered by itself,
and, second, the result effected by the
franchise when considered with rela-'
tion" to the city and state," the su
preme court says in its decision.
"If tho franchise is deemed a con
tract between the city and the tele
phone company, then the mere fact
that it was made prior to the enact
ment of the public utility statute and
before the state attempted to regu
late the rates, docs not debar the
state from increasing the rates fixed
in the contract between the parties
for the reason that the law wrote into
it a stipulation by the city that tho
sale could at any time exercise its
police power and change the rates;
and therefore when tho state does ex
ercise its police power it does not
work an impairment of any obligation
of the contract."
Regulation Is Police Power.
The supreme court holds that as the
right to regulate rates is essentially
a police power, the argument of
Woodburn that a constitutional pro
vision took from the legislative as
sembly the right to legislate concern
ing regulation of rates is not well
taken.
"While the constitution grants to a
city the right to enact and amend its
charter and simultaneously prohibits
the legislative assembly from enact
ing, amending or repealing the char
ter for any city, nevertheless neither
the grant nor the prohibition include3
any subjects except those that arc
purely local and municipal in charac
ter,' " says the supreme court.
The right to reguiiite rates is s
matter of general concern and does
not pertain solely to local muncpal nf
fars, the court finds.
Slate Is Interested.
"It is true that the regulation of
the rates for lelophonc in Woodburn
may not immediately affect tho rock
etbooks of all the people of the whole
state any more than does tho prose
cution of a person in justice court for
assault and battery, when taken alone
and by itself, directly nffect all the
people of the whole shite, and yet the
state is just as much interested in
promoting the comfort and general .
welfare of all the people as in .re
serving peace for all the people," says
tho supreme court.
The franchise granted by Wood
burn was valid until the state cheso to
speak, it was pointed out.
