Jimmy, of the shoe shUiing parlors next to Sherry's theatre, had a lot of fun with the biir snow banks. He made war trenches, laid mines and did a number of European stunts. One day when his trenches were in fine shape he hoisted a small French flag over them, but took it down shortly. "Why did you take down the French flag, Jimmy? asked a re porter. "I saw Herman Roesch and two or three other Germans coming down the street," said Jimmy, "and I thought I had better use a little diplomacy." Frank Harris is the busiest man in town. He has a spade in Mb hand most of the day opening ditches through the snow so that water from Adams avenue can get away. . Yes terday when he was at work at the Elm street intersection Toy Young, a Chinese irrigationist watched Frank, and finally Toy remarked "One would think Mr. Harris had tak en lessons in irrigation from the way he handles that water." Adv. "A fellow from Ladd Canyon told me today that a ground squirrel was out," said Alex Cochran today. The reporter looked at Alex expecting further remarks, but none came. Finally the reporter said, "What does that mean, Mr. Cochran?" And Alex looked off toward Mt. Emily's snow-capped summit saying, "it means the ground squirrel will freeze if he does not go back pretty quick." "Minimum Requirements" contain ing a list in spelling and in correct usage for the schools of Oregon, pre pared under the auspices of the Ore gon Council of English teachers, is the title of a new pamphlet being dis tributed by State Superintendent Churchill through the county school teachers. In the way of pre face the superintendent remarks.-! "This pamphlet is in no way to take the place of the Course of Study, but rather to supplement it. A few essentials in spelling and cor rect usage are indicated by the grades, and the work of the teacher is made more definite through the minimum requirements in these grades." That the business, now going east and west by rail, bring business pros perity to railroad centers will continue for some time to come is indicated from information given out by the O.-W. H. E. Lounsberry, general freight agent, advises Local Agent J. H. Keeney, as follows: The follow ing statement was made on the Mtn to Earl I. Brown, corps of engineer"), United States army, acting chief of office, at Washington,. D. C. "There have been several reports recently in the newspapers to the effect that the Panama Canal officials have sent out notices that the canal would be ready for all traffic Feb. 15th. A cablegram was sent to the Isthmus inquiring wnetner tnere was any truth in these reports and a reply has been received advising that the reports are without foundation and that the conditions on the Isthmus are still too unstable for the authorities there to make any prediction as to the probable date when the canal will be opened." Herewith is the decision of Judge Knowles denying the appeal for a temporary injunction in the Sunday closing issue: The above cause is before the court for decision upon the application of plaintiffs to restrain the defendants as District Attorney, and Sheriff of this county from enforcing the Sun day closing law so far as these plain tiffs are concerned. The law known as the Sunday clos ing law, is Section 2125 L. O. L. and reads as follows: "If any person shall keep open any store, shop, grocery, bowling alley, billiard room, or tipling house, for the purpose of labor or traffic, or any nlnce of amusement, on the first day of the week, commonly called Sunday, or the Lord's Day, such person upon conviction thereof shall be punished by a fine of not less than live dollars, nor more than fifty dollars, provided that the above provision shall not apply to theatres," the keep ers of drug stores, doctor shops, un dertakers, livery stable keepers, butchers and bakers; and all circum-sttim-es of necessity and mercy may be pleaded in defenso, which shall be treated as questions of fact for the jury to determine when the offense is tried by jury." An assault is made upon this law upon the ground that it is violative of Section 20, Article 1 of the constitu tion of this state, and Section 1 of the 14th Amendment to the constitution of the United States. Section 20 of Article 1 of the constitution of thuj state reads as follows: "No law shall be passed granting to any citizen or class of citizens priv ileges or immunity which upon the same terms shall not equally belong to all citizens." SectionJ of the 14th Amendment to the constitution . of the United States reads as follows: "AH persons born or naturalized in the United States and subject to the jurisdiction "thereof are citizens of the United States, and ol the state wnere in thev reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citi zens of the United States; nor shnll any state deprive any person of life, liberty or property without due pro cess of law, nor deny to any person within its jurisdiction the equal pro tection of the laws. Before the decision in the case of Marbuary vs. Madison, 1 Cranch 137, the" authority of the judicial depart ment to declare an act of the legisla tive department of the state or nation invalid because conflicting with the fundamenal law of the state or nation was a debatable question, but Chief Justice Marshall, of the Supremo court of the United States in the above celebrated case, settled that question once and for all, and ever since such decision, if an act. of a legislative assembly of a state con travenes the constitution of 1 such state, or of the United States, the courts have a right and it is their duty to declare the invalidity of such an act. The Supremo court of this state, however, in a long line of de cisions has held that the courts will not declare an act of the legislative assembly unconstitutional, unless the invalidity and unconstitutionality of such act appears beyond a reasonable doubt. State ex rel Lord, 28 Oregon 498; State ex rel vs. Malheur Court, 26 Oregon 61; Cadderly vs. City of Portland, 24 Oregon, 118. It has also bren hold by our Supreme court in the ca se of McMahan vs. Olcott 133 Pacific 836, that tno courts can not question the wisdom or the policy of the law, this 'being a legislative or political question. In the case of State vs. Nichols, 151 Pacific 473, decided September 14, 1915, our Supncme court held that the so called Sunday closing law does not contravene cither of the above pro visions of the state and federal con stitution, and therefore is not void fot (Continued oo page 8.)
