These . proceedings having been commenced ' before the adoption of the charter of 1913. It is claimed however that the char ter of 1909 and 1913, are both abor tive and invalid, and that our far famed commissioner form of gov ernment "should be relegated to de suetude" for the reason that under the constitutional amendment above quoted, Section 2 Article .11, the leg al voters have power to enact and amend charters, but not to re peal them, and that the attempt to repeal the charter of 1885 by the enactment of the charter of 1909 was ineffective, and that said charter--of 1885 is still in full force and effect, and as the proceedings for the impro vement of tourth Street are not authorized by said charter of 1885, said proceedings are void. Certain ly the power to enact a charter would include implied authority to repeal a former charter. In the ease of Branch vs. Alby, 142 Pac. 598, the supreme court of this state savs: umi , ... ine conclusion seems to be lrres istable that the people by the adop tion of said amendment intended to withdraw from the legislative assem bly all power that it previously pos sessed to enact, amend or repeal charters, or acts incorporating cities and to confer upon -the legal voters of cities and towns all said powers except the right to repeal." I think the learned judge who wrote the opinion in that case, did not mean to hold that the legal voters of of a city had no right to enact an entirely new charter, and thereby re peal a former charter, either direct ly or by implication, but that the legal voters could not repeal a char ter so as to leave a city without . any charter, or commit "Municipal bu cide," as Judge Burnett expresses McKeon vs. City of Portland, 61 Ore gon 385. Believing as I do that there is no objection to the proceedings that can be taken advantage of by means of a writ of review, the writ will be dismissed, and the defendants will recover from the plaintiffs their cost's and disbursments in this proceeding.
