by the federal judiciary in the case

etc. ' The courts decided that the
questions" of dividends is a question
of fact and hot of law. They de
clare that the facts must necessarily
be .ascertained in each particular

tion of the insurance clause would
occur, Hull said: ,
''The insurance companies in mak
ing their income tax returns to the,
federal authorities will deduct from
their taxable "- income all excess
