of The Observer: The recent elec
tion contest between myself and Kid
dle over the' Joint senatorship from
the 21st senatorial district, has been
given already much 'more publicity
than such a small office deserves, and
for the first time I discuss It In the
newspapers, on account of the many
Inquiries received by jne relating to
the same, and In answer to these In
quiries will aay;
That I have been honestly and
squarely elected to that office by the
people of this district, overcoming a
registered ; republican plurality . of
about 1400 votes, and being elected by
a small plurality as Is shown by the
judicial recount made by Judge
Knowles. I carried every precinct In
the city of La Grande,' my home town,
though strongly 1 Republican. The
state senate refuses to receive the
judicial recount, and being the final
judge of the election and qualification
of its own members, has the right
to decide the matter of who shall ait
there to use petty politics, tf It sees
fit to do so, even' In the face of a
judicial record, which every sensible
man must concede is more likely to
be right than the count of election
boards of the different precincts made
under the disadvantages surrounding
them, .1 '
The corrupt practice act enacted
by the people of this state provides
a method of recount fn case of con
test of legislative offices, and this the
court did In the manner required by
law, and certified Its findings up. The
position of the court In such case is
merely that of a canvassing board t
assist the legislature In its recount.
and afford the safeguards surrounding
a judicial form removed from ' the
rancor and prejudice of partisan pol
itics. In this case the court made
its findings fairly and impartially,
and constitutionally as well for the
highest courts In our country have
held that such a recount Is not an in-
! vasion of the rights of the legislature
.to determine the election and quallfl
cation of its own members, but only
' a convenient method of - recounting.
