Indicted officers of the Oregon Lum
ber Company yesterday began a techr
nicai battle for liberty In the United
States ' courts,' relates the Oregonian.v
David Eccles, Salt Lake millionaire,
the Mormon church, Is the chief de
fendant. With Grant Geddes, manag
er of the company, and a number of
other associates, Mr. Eccles Is ae
cused of. entering a conspiracy to de
fraud the government of timber lands
in Baker and adjoining counties on
the east side of the state. '
The Indictment was returned by Vie
federal grand Jury but three 'days be
fore the statute of limitations twould
have run against any criminal prose
cution.' And In order to get within the j
law' at all, the crimes charged; are
based on the last overt act alleged to
have been committed. The United

the statute of limitations had expired

cured by the conspirators, and the
finding of the indictment. Mr. Mc
Camant held that the performance of
each overt act mentioned In the , in
indlctments formed a separate crime
and should be bo treated. He relied
largely upon the Willard N. Jones cse
which was appealed t the circuit court
of appeals and wherein Judge Ross
held that each overt act was subject
. to he statute of limitations. In other
l caseB in this district the opposite po-

' On the motion to quash Mr. McCam
ant argued that the Indictment was
vague and failed to clearly charge the
defendants with the crime upon which
the government would attempt to se
curt) conviction. 1
Briefs will be filed for the advice of
Judge R. S. Bean, who has the case in
charge, and In all probability it will
be several weeks before a decision enn
be rendered.
David Eccles was not In the court
room, nor did Mr. Geddes appear, al
though Iip was In the city. Mr. Eccles i
is supposed to be spending the summer
