If infested means where, the worms have been, then It Is unlawful to ship to Walla Walla, to sell to the vinegar man. or the cider man to make apple Jack, to the man who makes dried fruit, to the 'butcher man-who feeds them to hin hogs, or to any person for any pur pose or no purpose whatever. The prohibition is absolute and un iuafled but it seems that no objection has been made except In the case of a poor person buying the' fruit for home con sumption. The discrimination is made argainst the party buying who needs most to buy, who uses the ap ples in the manner most cleanlv and less liable' to produce deleterious af fects. Then, if it is true, that infest ed means a present occupancy, or on act being consumnated at the present time, and that the apples are not In fested with worms after the time has elapsed for them to make their escape, wherein lies &! misdemeanor )u sel ling a few. cheap apples to a needy family or for any other person for whatever purpose he may wsh to nse them.
