Now, coming back to the prohibit
ion of the sale of Infected apples as
hereofore quoted from the law. It
shall be unlawful to sell any Infested
fruit of any kind In the state of Ore
gon. Every person who prepares for
shipment, delivers to any agent to be
transported within or without the
state any freBh, cured or dried fruit
that Is Infested with insect pest Is
guilty of a misdemeanor. If infested
means where, the worms have been,
then It Is unlawful to ship to Walla
Walla, to sell to the vinegar man. or
the cider man to make apple Jack, to
the man who makes dried fruit, to the
'butcher man-who feeds them to hin
hogs, or to any person for any pur
pose or no purpose whatever. The
prohibition is absolute and un iuafled
but it seems that no objection has
been made except In the case of a poor
person buying the' fruit for home con
sumption. The discrimination is
made argainst the party buying who
needs most to buy, who uses the ap
ples in the manner most cleanlv and
less liable' to produce deleterious af
fects. Then, if it is true, that infest
ed means a present occupancy, or on
act being consumnated at the present
time, and that the apples are not In
fested with worms after the time has
elapsed for them to make their escape,
wherein lies &! misdemeanor )u sel
ling a few. cheap apples to a needy
family or for any other person for
whatever purpose he may wsh to nse
them. The strict inforcement of this
law, If worm holes means lnfeied.
signifies that cider mills, vinegar
plants, dried apple evaporators, butch
er shops or any other person must
look elsewhere for their raw material
go out of business, or buy apples only
of the "fancy packs." 1
Such an absurdity as this was never
contemplated in the law. If the sale3
can be made to any of the parties men-
i tloned, why should any discrimination
jrun against any other person T
