George Otis Smith, di rector of the geological survey rose to defend Ballinger, and was replied to by Ex-Governor Pardee of Cali fornia. Smith defended his superior in gallant style, and endeavored to convince the delegates that Ballinegr had been misrepresented. Smith said It has been charged the secre tary failed in his stewarasnip. in April, Ballinger restored lands and again withdrew those covering power sites. This concession was made to Montana citizens because they wanted agricultural land. If these lands were 'restored in April, why did the power interests wait till June to file; while writers have been fabricating we have heen withdrawing lands. I believe there has been too much crtic'sm against public servants at thi3 congress." Pardee replied: "I said yesterday I wa3 sorry Bal linger left the hall when he did, but am glad he sent a man to defend him. I call your attention to the fact that Ballinger restored all lands. Why were agricultural lands restored and others eliminated? I have been told the reason wa3 because the pres sure of ' agriculturists, some laweyrs and some power men. Deing iuipnt:aieu " alleged holdup In the local yards two nights ago when Macllroy affirms he was assaulted and robbed, aws turned loose late last evening, and both sus pects are now at liberty. The one against whom most sus picion lay, based on statements made by Macllroy during the brief conver sations held with him before he dis appeared yesterday morning, was held as long as the statues wouia permu without a hearing and when that time expired he was released. Macllroy has not been found yet. A case is being tried in the probate court today where the guardianship of s. M. Bloom of Cove, is involved. Mrs. Bloom the wife of the defendant is asking the court to appoint her the guardian of Mr. Bloom alleging that on account of a paralytic stroke he is not capable of handling his finan cial affairs. There are a large number of wit nesses to be examined on each side and it is thought the case will con sume considerable time. Mr. Bloom is suffering with an attack of paraly sis and physlclally he is disabled, but mentally he seems to be very bright.
