The Impression today Is that if Bal
linger fails to explain satisfactoi ily
reclamation and water power arts,
the congress will press a strong reso
lution condemning him and demand
ing a change of policy or his removal.
In any event his past acts are sure

Ballinger Replies.
When Ballinger was introduced this
afternoon, declared his adherence to
principles of conservation, and defend

left the matter of the personnel of re
clamation service untouched. He said:
"It is not the policy of the govern
ment to interfere with the investment
of private capital in the construction
of irrigation works, but rather to lend
its encouragement I am not a be
lelver In government competitlng with
legitimate private enterprises."

PORTLAND, Aug. 11. The Wash
ington correspondent of the Evening
Journal says today that the Washing
ton Times prints a, statement from
their correspondent at Beverley, Mas
sachusetts, high in the confidence of
Taft, that it is regarded as certain
In administration circles that Director
Newell is slated to go.
The Times says: "Cessation of
Newell's work for the government Is
regarded as a settled fact. Ballinger
on his western tour become more de
termined on this move, and the re
organization of his department Will
begin with the reclamation bureau."
Commenting, the Journal's corres
pondent says: "The same article con
veys a hint that a similar fate awaits
Plnchot, and suggests Ballinger is
hostile to the methods hitherto em
ployed in reclamation and forestry
bureaus. He -dwells on the alleged
practice of going beyond the legal au
thority by both Newell and Plnchot
and interprets Taft's telegram to the
irrigation congress as meaning he will
uphold Ballinger in these contentions.
Friends of Newell and Plnchot here,
believe that the plans have been form
ed to force both men from the gov
ernment service.

CHICAGO, Aug. 11. Sara Berger
representing James J. Jeffries, and
George Little representing Jack John
son, agreed to conditions that will
govern the fight for the world cham
pionship. The articles were signed
this afternoon. Berger holding Jeff
ries' power of attorney agreed 20 to
100 rounds, the division of the purse
to be left to Jeffries.
The club will be selected within 60
days, and the contest is to be fought
within six months after.
Brewster Is Destroyed.
SPOKANE3, Aug. 11. A messag
from Brewster near here Indicates the
town Is almost annihilated by fire.
The loss is $50,000.

A man hardly able to walk and
afflicted with what was thought to be
appendicitis, and also frightened that
he will be taken back to Baker City
and be operated on for that disease,

Baker City. .
The 'man's name is Harry Frank,
and has for some time been confined
in the Baker county Jail for some mis
demeanor. Last week the man coin-"
plained of a pain in his side and after
an examination it was thought that
he was suffering with appendicitis,
and was ordered removed to the hos
pital to be operated upon. At this the
man put up a strong objection, saying
that he had rather remain in Jail than
be operated upon. Nevertheless he
was taken to the hospital Saturday
and the operation was to be performed
Sunday morning, but the next morning
their patient was not present, and
upon investigation it was learned that
during the night the bird had floWn.
The man stated today that he es
caped from the hospital and catching
a freight went to Union and from
there he walked to Hot Lake. He was

Hot Lake, failing down in the lobby
unable to move. The. physicians there
learned who he was and how he came
to be there. The lake officials then
phoned the sheriff here and stated
that the clerk at the lake would bring
the man to La Grande. ' This was done
and he la now in Jail here awaiting
the Baker officials. The man Is still
suffering intensely, but It Is thought
that his ailment is not appendicitis. ,
SICILIAN SPENDS SIX YEARS TO
AVENGE BROTHER.
Comes From Italy to Shoot Fellow SI

NEW YORK, Aug. 11. Amat San
ticello, aged 17. and a Sicilian, is
Jailed here today after shooting five
times at Rafael Gacone. Amat has
been praying ceaselessly for the death
of his victim.
To kill Gascone, Amat came here
from Italy. Six years ago Gascone's
brother shot and killed Amat's broth
er and cousin. Gascone was tried,
found guilty and sentenced to death.
He was imprisoned near the lawyer
Albert Patrick In the Tombs, who be
came Interested In Gascone's case and
secured a reversal. ;
Later Gascone was transferred to
a cell near Harry Thaw who also be
came Interested and supplied money
for Gascone. Gascone after he shot
drew a knife and stabbed Amat It is
thought he will recover, but Gascone
will probably die.

Shady Color Goes With Robbery Storf
of Last Night. .
One of the suspects arrested last
night charged with robbing William
Macllroy, was released from custody
this afternoon and the second will be
let go tonight, unless Macllroy Is
fonnd In the Interim.
Inability to find William Macllroy
after a diligent search ot the city's
highways and byways, has led the po
lice to believe that the alleged hold
up last evening at 6 o'clock, when
Macllroy ' says he was assaulted,
bruised and robbed by four men with
whom he had been keeping company
for Bome time, ma) be something of
a farce. Two men were arrested on
suspicion last evening, and today they
have beeu held in Jail pending discov
ery of the whereabouts of the pros
ecuting witness, the man said to be
robbed. From early morning until
well along in the afternoon, the search
has been going on for the witness.
Men who are in the city today In
formed the police that Macllroy has
been working In Baker City, and was
never seen, during that time, to have
more than (15 or $20 in his posession. '
The probe to ferret out the facts
in the case, led to the discovery by
Chief of Police Rayburn and his as- .
slstants, that Macllroy had been seen
with the men going to and from the
box cars in the yards, and It is said
"cans" of beer were, playing import
ant parts in their movements. .
