Any water user may. petit I mi the Board for a determination oi' all wa ter rights upon the stream. Blank forms for such petition can be se cured by addresElng the Secretary of the Board at Salem. This determina tion will be based upon surveys and measurements by the State Engineer, and upon the testimony of each claim ant. This testimony will be taken by the Superintendent, In the shape of answers to questions upon a blank form. It will later be submitted for the inspection of all interested par ties and an opportunity given to con test any of the information offered. Based upon the evidence collected. mn order will be entered by the Board of Control, determining the rights of all claimants on .the stream. This order becomes- effective at once and can be enforced by the appointment of a water master. It is- later lied with the circuit court for confirmation Upon final determination by the -.ourts a water right certificate will be Is sued by the Board of Control, based upon the decree. This certificate will bear the same relation to the water right as. a patent from the United States does to the land title. The cost to the water useis for a determination of the right is small. Where such stored water is to be released into a natural channel, a separate ap plication must be made by each per son ; who contemplates its diversion and use. In this way,. toe records are complete. ' ; The water master Is required to pro tect stored water as It passes down the stream, and permit Its diversion by those entitled thereto, less an amount lost by seepage and evapor ation. ' In this way, the investment of capital in storage works is made safe, and the delivery 6f the water assured, Construction work must begin with in ono year from the dato of approval of the application, and be persecuted with due diligence and be completed within not to exceed five years from such date of approval. . The basis of the law Is priority of appropriation and beneficial use. All water used for Irrigation purposes must remain appurtenant to the land upon which It 4a used.", The use Is the basis of the right, and not the ca pacity of the ditch or the appropri ation made. Upon termination of the time allowed, proof, Is taken by the Superintendent In the same manner as for original determinations, and a water right certificate is then Issued, based upon the. extent to which the water has been actually applied to beneficial use. The water right cer tificates, as Issued for old rights, are thus plaed upon the same footing as those Issued as a result of a permit under the new law. WATER POWER CHARGE. This charge is to be based upon the percentage of power appropriated which is put to bneflcial use.
