Four-Indictments were re turned for alleged timber fraud In the Boise basin against James T. Barber, Sumner G. Moon, Frank Martin and Albert E. Palmer, says the Boise News of Tuesday. The ball of the defend ant Martin was fixed at 12500. on his own recognizance and each of the other defendants at $5000 with suffi cient securities. An order to this ef- feet was given to the clerk of the court by Judge Deltrich Immediately after the indictments were returned to the court. : The defendants are Indicted for con spiracy to defraud the United States and for violation of section 6440 of the statutes. They are charged with unlawfully ' conspiring. combining. confederating and agreeing together, and with Frank Steunenberg, William Sweet, John Klnkaid. Louis M. Prlt- chard, John I. Wells, Patrick. Downs and divers other persons whose names are unknown to the grand Jury. They are further charged with knowingly, wickedly, . falsely and corruptly de rrandlng the United States out of large tracts of timber lands east of Boise, In the county of Boise. ' . Four counts were returned against the defendants three of whfch are a! ieHBu oiienses mat took place on April 20, JK05, September 1. 1905 and September 1, 1901. These Include the second, third and fourth counts The Indictment bs handed to the court contained 40 pages, being a bulky vol ume, as It contained the names of the witnesses called before the Jury dur ing its Investigations. When the Jury reported to the court the indictment' was handed to Judge Deltrlch together with a report of the grand Jury.
