FILED SUIT Tomorrow the Oregon Railroad and Navigation company will-file a suit in equity in the circuit court of this district for the purpose of showing that the as sessment of $12,000 per mile upon their roadbed is unjust. Ever since the com promise pro posit an presented the county court by the railroad was turned down, it has been expected that a suit would be started by the company. However, the first definite news came today in the shape of a message from the legal office at Portland to Col. Raley, saying that the papers for the suit will be here tomor row. With the filing of the suit in equity will commence another chapter of the legal war that has been waged for the past year or more between the railroad com pany and the county and in which the latter has been signally successful so far. What the outcome of the coming fight will be remains to be seen. It is barely possible that the matter may be adjusted without having the case tried.-East Ore gonian. Gap Bridged S. R. Haworth has let the contract for the construction of a cement sidewalk in front of his brick on Adams Avenue which will complete the sidewalks from Fir street to Grandy Avenue. The side walk which was left unbuilt has been a menance to pedes terians and an eyesore to the street, Is commendable' in Mr. Haworth to complete the walks in com pliance to the city ordinance, Mrs Moss Improving Mrs William Moss, of Island City, who submitted to an operation for a tumor Wednesday at St. Anthony's Pendleton rallied from the operation and is much improved today.
