That for the purpose of such improvement and to provide means tor to payment of the aame, the ap praiser shall as soon as the actual cost haa been ascertained, assess all of tbe real properly, within said Sewer Pis trict No. 2, above described, such asaesa men t to be determined by ait equitable apportionment of such real property among all the real estate owners In said Sewer District, bassd upon the last pre ceeding couuty assessment of real estate only, and not npon the Improvements thereon ; and the costs and expense of making such improvements shall be a charge against and a lien upon the property within said Sewer District In accordance with auch apportionment; Section 4. That as soon as such ap portionment has been made the Record er of said City shall enter ia a docket for that burpose, by name or number, a description of each lot or parcel of land against which said assessment is made, with the name of the owner or owners, and the amount of the oaptld assess ment. That sail warrants shall be drawn in such form and denomina fions that tbe said taxes or any part hereof, when collected, may be made immediately applicable to the payment of some portion nf raid warrants, and final payment shall not in any instance extend beyond the period of ten years ; sections, inst as toon as the ap praisers shall have made the assessment provided for in Section 3 of this ordi nance, the Common Council of sa d City shall publish notice of such assessment for three successive weeks in a news paper published in said City, requiring all persons owning property in said sew er district so assessed lor such improve ment In the turn of I J5 00 or more, at any lime within twenty daya from the date of tbe first publication of ench no tice, to file with the recorder of said City, a written application to pay said assessment in installments; such appli cation shall state that the said applicant and property owner d-es hereby waive all irregularities or defects, jurisdictional or otherwise, in th proceedings to make such improvemeoU for which said assess- ment is levied and in the apportionment of tbe cost thereof. Said application shall contain a provision that the said applicant and property owner agrees to pay said assessment in ten equal an nnal insUllmentt, with interest at the rate of six per cent per annum, payable annually; section v. mat tbe applications so received shall be entered in a book kept for that purpose, showing the date of filing each application, tbe name of the applicant, a description of the property, and the amount of (he assessment; Section 10. That thereafter there shall oedue and payable annually for ten suc cessive years to tbe recorder of laid City, by the owner of each lot or parcel of land aaaessed for the said sewer Im provement whose application to pay the cost of such sewer by installments has been filed as herein provided ten per cent of the cost of said sewer assessed against rhe property of such owner, as appears by laid lien docket, with tbe am-rant of one years interest at six per cent perannum on all unpaid assess ments or installments. That first pay ment aforesaid, shall be due and pay able at the expiration of one year from date of the said assessment in the lien docket aforesaid, and subsequent pay ments at the expiration of each year thereafter.
