B..v.lt l, l, l i prwnt time is more pr-ople to come foresight to destroy about thre dozen letter books, contaiiiiiig letters lieaiing upon subjectaof public int rest. So long as he continued in office these letter Dies were allowed to exist, but when bis resignation wss demanded and it was certain that bis course as a public offi cial waa to be investigated, lie caused them to be destroyed. That the verdict is the only one the jary could find umier the charge of the court we must admit. The judge ruled that it n as rot enough for the jury to be convinced that Uje books destroyed contained official let ers; not enough that it be convinced the books formed part of the records of the Land office or that tbey a ere referred to by the Land (Jffiee employee? that it mcst be satisfied that Herman knew their contents to be official ; ki ew that in destroying them be was destroying records that would be called for in con nection with subsequent land ollice business, and that it must further be convinced that the custom and practice of the effice required that such letter books be left permanently in the Land Office. Such a charge was equivalent to an instruction to acquit and should have been accompanied, as was the charge in a customs rase in Oregon many Tears go, by the information that if the jury tailed to acquit the judge Would Set aside the verdict. Then we are told that after the verdict Heimanu shook hands with each mem ber of the jury, hid he shake bands with the judge during tha progress ot the triai? If so there is no cme for wonder at the charge. That Hermann double hand shake, grasping the eliow with the left and the victim's hand with the right, with a fatherly inquiry after the wife and children, has been Dinger's greatest political asset during bis long and successful political caieer in Oregon j and we have no doubt it would work just as well with a Washington judge as it did with the horny handed farmers of the Willamette Valley. This is Binger' second vindication. The erst was when the people of his district, influenced largtdy by I're?i dent Roosevelt's recognition of the man whom he had dismissed from office, elected him to Congress. Certainly Einger is a lucky man, or else there is something bark ot thes land trials tfiat the general public doe not see. J udged from thecommon view point Hermann was the wor.it raHMl of the bunch. His co operation was abso lutely necessary to the success of the plotters. With an honest man ai Com missioner of the Geneial Lir.d Office such Irauds as were perpetrated during bis administration would have b-cn absolutely impossible. II is subservience to the wishes of the land ririjj b;m coit the people millions upon millions, and yet it is more than probable that he will escape fCOt free.
