The proceedings of the County Court for the January, 1'JtXl, term are es follows: Ordered that following be deducted from District No. 5 and added to District No. 4: Beginning at Columbia River on line between section S3, 0-1 and section 4, 6-1, thence west to southwest corner of southeast qr of southeast qr section 3tl, 6-2; thence north l'j miles; theuce east to Columbia River; theHce following shore of Columbia River to place of be ginning. No action was taken in the matter of petition of V. L. Brown et als for change in route of county road. The petition of John Pringle et als for change in route of county road was post poned to March term. ' In the matter of approving the plans for outlay of special road tax, in the sev eral distr cts levying same. Road dis tricts having heretofore filed their no tices of special tax levies for road pur poses, also the plans adopted for the out lay of same to wit: Road districts No. 4, 13, 14 and 15. It is ordered that same ' approved, and matter is hereby re to the County Jnde, to prepare vjnents calling for bids for mak yposed improvements, to be sub ato this court at its March, 1006, In the matter of changing route of county road in District No. 7. Ordered that the Board of County Road Viewers view and survey proposed changes, and that they meet at a time to be hereafter et by County Judge for this purpose. O E Hunter granted liquor license for six months. In the matter of examining and approv ing the reports of receipts and disburse ments during the year 1905 of the several road supervisors. Reports of the follow ing road supervisors examined and ap proved: Districts 1, 2, 3, 7, 8, II, 12, 13, 14 and 15. Ordered that bondsmen of said road supervisors be and they are hereby relieved from further liability in this matter. In the matter of drawing the jury list for 1906, the court drew the list from the names appearing upon the tax roll of the '- 1905. In the matter of the protest of A. G. 'Hotchkiss et als to approval of work known as specification No. 1, R. D. 15. . Court finds that said work has been ap proved and paid for some time ago, and it is therefore without jurisdiction in the matter. In the matter of the complaint from City of Clatskanie regarding obstructions in county roads. Ordered referred to su pervisor of R. D. 10 with instructions to remove any such obstructions. The petition of the Warren Packing Co. to lay pipe in county road was grant ed, but must not interfere with public travel. In the matter of designating the official county newspaper for the year 1906. Pe titions of Oregon Mist and Columbia Reg ister considered and petitioners given till 10th inst at 2 p. m. to file statements of their bona fide yearly subscribers within the county. S. A. Crossby allowed county aid to the amount of $10 per month, clerk to draw warrants on the 1st of each month until otherwise ordered. In the matter of the petition of John F. Cheldelin et als for a county bridge in R. I). 13. Ordered that petitioners or others interested may submit plans und specifi cations and bids thereon by February 14. The seven petitions of the O. R. & N. Co. lor cancellation of and return of taxes on various tracts were laid over until next term for investigation. P. paid 1-10 of the total tax dur ing the years of '00 and 1)7, and will pay l-13th of the total tax for the year pJOa Now does Mr. Flagg expect the valuation of the N. P. property to keep pace with the total valuation of the county, or in other words if the N. P. paid 1-10 of all taxes in year 1S96, it should pay 1 10 of all taxes in year 1905. "R. P. HATTAN, "County Judge." We can see no argument whatever in Judge Hattan'a statement. Tho Board of Equalization is not supposed to keep track of the comparative prosperity oi corporations and individuals. Its duty is prescribed by law and is plain and mandatory. It is to equalize the assessed valuations as made bv the county assess or. If the railroad companies were as sessed at a greater proportion of their true value than wera private individu als, then it was the duty of the board to bring thetn both to the face value pre scribed by law; but if not, then it was the plain duty of the board to either sus tain the assessor or raise his figures until they bore the same proportion to the railroad's true value that his assessment of other property bore to its true cash value. It seems to us that there is no escape from this conclusion. The purported transfer of the A & C. road to the Northern Pacific revealed the fact that that road is valued at ?S3,000 per mile, ;.d is paying six per cent in terest on that amount. It trnuscv-tids all other pub lic questions in its importance ami it is pressing lor settlement in both the lovtit and national fields. We ate told that if tho assessment were higher tho company would resent it and tsko the matter into the courts. We quote from a pamphlet on assess ment and taxation a portion of an ad dress delivered by Charles P. strain, as sessor of Umatilla Countv, when this matter of railroad assessment was before the County Board of Equalisation of that county; "The officers ol this company know, and I know, aud you can know, that their road in this county is assessed at less than ouo-third its full value. "I assert without fear of successful contradiction that ninety out of every one hundred taxpayers have belter grounds for resitting their assessment than this corporation. "L'poli what grounds, then, can this court remove front this corporation its taxes and place them upon the shoulders of resident taxpayers? "I assert that it not only seeks to evade its tax. It does worse. It strikes at the foundation of representative gov ernment. "The logic of their position is that, hik ing been favored in the past, they art entitled to an everlasting continuant of the same treatment. "Sirs, you have no more moral right to red lie i the aseejsnient upon this com pany's property below one-third its full value than you have to abstract the money from the pockets of ono man and empty it into those of another. Mr. Strain was assessing property in Uma tilla County that year at one-third its full value.) "Gentlemen, it is np to you. It is for you to decide whither this corporation shall pay its own taxes or whether the public shall be made to pat them." Mr. Strain was sustained by the court ami the railroad company appealed, first to the circuit court and then to the Su preme Conrt. They were beaten and compelled to pa their taxes. Mr. Strain aim "I aimed to assess property at one-third of its full value, hence I considered that company's rouJ- bed worth t3G,000 per mile." Captain Maker will go to bis hometown for the necessary appliances, and expects to return in March to float the steamer. He says she rests iu a dirfi cult position. Mr. Petersou, who was a sailor once upon a time, also donned the diving suit and inspected the bottom of l the hull. II. C.
