Impeachment must be warranted, scholar says By Stanley Nelson Of (to f mr raid The implications of the im peachment process is vitally im portant to know if the United States is to restore integrity to the federal government, a legal scholar said on Tuesday jonathan Alack, with the Center for Scholarly l.«gal Research, spoke before a crowd of more than !>t) people in the Harris Hall chambers of the city hall. Aleck stressed the forum was not meant to advocate or en courage the impeachment of the president, but to address the responsibility America has to proceed with impeachment if evidence warrants. The meaning and implication of the impeachment process must be contemplated and understood thoroughly, he said. Just as a doctor understands the risks and necessity of surgery, so Congress must invoke im peachment if warranted, he Mid Distinctions must be made between the presidency, the of fice and the president himself and what he can be held ac countable for. as well as the policy and the institutions of government. Aleck said "There is no real rule in what standard of truth is necessary in a presidential impeachment." he said, but it must be clear and convincing, which is more than what is expected in a civil raise but less than a criminal case Much of what the president is being charged is hearsay, and much involves national security cpiestions that the president can invoke executive privilege, to exclude from public eye, Aleck said Charles Black, a conservative law professor at Yale Universi ty. has stated the definition of high crimes and misdemeanor, which is grounds for ini|>each ment. is meant to be broad and relatively undefined. “ 'Those offenses are those which a reasonable person might anticipate would be thought abusive and wrong without reference to partisan policy or difference of opinion on policy.' " Aleck quoted of Black. What must l>e determined is what actions the president knew to be in violation of U.S. policy, and the present Iran/Contra hearings are invpor Unit to gather information to determine that. Aleck said. The talk was sponsored by the group Restore integrity to Na tional Government RING form ed in fune in light of the precedents set by the Reagan administration in departing from the constitutional re quirements of checks and balances. Its purpose is to encourage legislators to lake special care to protect our constitutional form of democratic government, ac cording to a statement of pur pose by RING co-founder Ralph Penunuri. KING'S goals include a call for the impeachment of Presi dent Reagan and a full federal investigation of his staff.
