Agency, anti-draft spokesmen differ on federal ruling’s effect By Michele Matassa Of th« Emerald A spokesman for Oregon's Selective Service System calls it "one man s opinion” while a member of Coalition Opposing Registration and the Draft says it is ' immensely encouraging " “It” is a federal court ruling that draft regis tration is invalid In Los Angeles Nov 14, U S District Court Judge, Terry Hatter, dismissed charges against David Wayte for refusal to register ‘ We re hoping people will understand that the ruling is just one man's opinion and that they will abide by the law," says Darwin Michaels, a Selective Service Unit Commander. Hatter’s ruling has two main arguments — selective prosecution and ' promulgation of regulations,” according to a press release by the national Central Committee for Conscientious Objectors. CORD consultant Ron Phillips says selective prosecution means the government is prosecu ting not only non-registrants but freedom of speech Draft resisters who publicly oppose registration are selected for prosecution while silent non-registrants aren't charged. Phillips says The argument charging promulgation of rules is based on the government's failure to wait the required 30 days for public comment before instituting registration, according to the CCC-O statement Phillips is encouraged that prosecution of offenders will be slowed down while the decision is taken to the 9th Circuit Court of Appeals and that the ruling may be upheld at the appeals court We re (CORD) immensely encouraged by it," he says. "This means the possibility that the whole draft system could be shut down " Phillips also says Hatter's move could become a national trend His decision may set court precedent for later rulings, he says An appeals court decision in favor of the rules promulgation argument "would make the whole thing (draft registration) a farce because some states would require registration while others wouldn’t," Phillips says He explains that the 9th Circuit, which in cludes California, Oregon and Washington, six other states and Guam, would be free from regis tration laws while the rest of the United States would be bound Hatter’s ruling could confuse courts for six months — the length of time he predicts the case will be at the appeals court — because non-regis trants could claim they thought registration was no longer in effect, Phillips adds Locally, CORD can’t do much to urge government support for Hatter's decision, he says All it can do is keep the issue in the local media because "the government and the courts watch the attitude of the nation, Phillips says In spite of his support tor the ruling.
