Agency, anti-draft spokesmen
differ on federal ruling’s effect

In Los Angeles Nov 14, U S District Court
Judge, Terry Hatter, dismissed charges against
David Wayte for refusal to register
‘ We re hoping people will understand that
the ruling is just one man's opinion and that they
will abide by the law," says Darwin Michaels, a
Selective Service Unit Commander.
Hatter’s ruling has two main arguments —
selective prosecution and ' promulgation of
regulations,” according to a press release by the
national Central Committee for Conscientious
Objectors.
CORD consultant Ron Phillips says selective
prosecution means the government is prosecu
ting not only non-registrants but freedom of
speech Draft resisters who publicly oppose
registration are selected for prosecution while
silent non-registrants aren't charged. Phillips
says
The argument charging promulgation of
rules is based on the government's failure to wait
the required 30 days for public comment before
instituting registration, according to the CCC-O
statement
Phillips is encouraged that prosecution of
offenders will be slowed down while the decision
is taken to the 9th Circuit Court of Appeals and
that the ruling may be upheld at the appeals court

whole draft system could be shut down "
Phillips also says Hatter's move could
become a national trend His decision may set
court precedent for later rulings, he says
An appeals court decision in favor of the rules
promulgation argument "would make the whole
thing (draft registration) a farce because some
states would require registration while others
wouldn’t," Phillips says
He explains that the 9th Circuit, which in
cludes California, Oregon and Washington, six
other states and Guam, would be free from regis
tration laws while the rest of the United States
would be bound
Hatter’s ruling could confuse courts for six
months — the length of time he predicts the case
will be at the appeals court — because non-regis
trants could claim they thought registration was
no longer in effect, Phillips adds
Locally, CORD can’t do much to urge
government support for Hatter's decision, he
says All it can do is keep the issue in the local
media because "the government and the courts
watch the attitude of the nation, Phillips says
In spite of his support tor the ruling. Phillips
agrees with Michaels, who says registration must
go on as usual
Michaels warns against waiting for an ap
peals decision to register Men should go ahead
and register because registration still is required,
he says
Phillips says the ruling may be overturned at
the appeals court and sent to to the U S Supreme
Court, a process he says may take a long time
Oregon has a registration compliance rate of
90 percent while the nation has a 95 percent rate,
Michaels says
In Lane County, men born in 1960-62 have an
average compliance rate of 94 percent, but an
average of 83 percent of those born in 1963-64
have registered, a selective service announ
cement says
Phillips says the recent prosecutions of non
registrants is simply a big-bluff scare cam
paign ”
Historians debate Brady theses
In an atmosphere punctuated by laughter
and "mischievious” wit, three history professors
and a graduate teaching fellow debated the idea
that history of Western Civilization is a "confused,
obsolete idea,”
Tom Brady, University history professor, is
the author of the "Theses on Western Civiliza
tion" which proposed the elimination of History of
Western Civilization In his theses, which he
distributed to the history department, Brady con
tended that if no one responded "silence is
tantamount to consent
Neither silence nor consent had any place at
the debate The three other panel members and
assorted members of the audience politely disa
greed with Brady, although in the final analysis he
"won the war” because he brought the depart
ment to an awareness of the issue, said history
Professor Roger Chickering, who acted as the
moderator
Professor John Nicols said Western Civiliza
tion is not obsolete because ideas like truth and
justice can be traced back through history
Professor Stan Pierson said confusion may not be
altogether bad, because it could lead to a “rich
ness of conception of the Western tradition.”
In the debate, Brady proposed a course on
World History that would be a prerequisite for all
history courses, would teach the basic
vocabulary of history and give students a histor
ical framework which would help them in other
classes
